A RESOLUTION AUTHORIZING THE EXECUTION OF A
LETTER OF AGREEMENT WITH THE WASHINGTON COUNTY
SHERIFF'S POSSE TO PROVIDE FOR SECURITY
SERVICES AS MANDATED BY THE FEDERAL AVIATION
ADMINISTRATION SECURITY DIVISION AND APPROVAL
OF A BUDGET ADJUSTMENT.
BEmIT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
I. -
Section 1. ' {'That. the 'Mayor and City Clerk are hereby
authorized and directed to execute the Letter of Agreement between
the City and the Washington County Sheriff's Posse to provide for
security services.at'the`airport-as mandated by the FAA due to the
war in the• Middle East. A .copy `of the Letter of Agreement
authorized for execution hereby is attached hereto marked Exhibit
"A" and made a part hereof.
Section 2. That the Board of Directors hereby authorizes
the transfer of funds from the Fund Balance to the Extra Services
for cover of security services at the airport and approves a budget
adjustment in the amount of $67,120. A copy of the budget
adjustment for approval is attached hereto and made a part thereof..

LETTER OF AGREEMENT
This agreement by and between the City of Fayetteville
Municipal Airport and the Washington County Sheriffs Posse this
date January 23, 1991 hereby sets forth a agreement for the
following services:
Security service protection as required and necessary by
the Federal Aviation Administration during levels of
threat against U. S. Airports as set for in the approved
Airport Security Plan.
The officers that are furnished to the site will be under
the direct supervision of Airport Management, and shall
abide by the directions prescribed by that office.
All officers located on the Airport property during the
term of this agreement shall abide by all instructions,
rules and regulations established.
All officers employed during the term of this agreement
shall be duly authorized law enforcement officers in the
State of Arkansas with full arresting authority. They
will at all times while on duty, carry only authorized
fire arms and use them in accordance with Washington
County Departmental Policy.
The hours and number of personnel are subject to change
as dictated by the Federal Aviation Administration (FAA),
however, in no instance shall this agreement be in full
force and effect after the time the FAA deems that
security is no longer a requirement.
The Washington County Sheriffs Posse agrees to furnish
personal in accordance with the above enumerated
requirements. The number of personnel required at the
time of this agreement should be sufficient to cover the
Terminal building during 19 hours of operation daily with
one plain cloths Wand one uniformed officer providing
terminal and grounds patrol 24 hours per day. The
vehicle patrol officer is required to achieve his duties
with one vehicle that is clearly marked and recognizable
as a law enforcement unit. It is clearly understood that
the hours of operation are subject to change, either by
increase or decrease and the Posse will adjust to those
revised schedules.
The rate for all personnel furnished during the term of
this agreement shall be ten dollars and sixty one cents,
($10.61) per hour per individual. The patrol vehicle
fuel will be compensated directly to the Washington
County Sheriffs Office. Billing for these services shall
be submitted every two weeks for payment. Any instance
of failure to perform the duties prescribed or failure to
follow procedures or rules shall be reported immediately
to Larry Dalrymple for disciplinary action or termination
of said individual(s).
It is further understood by both parties that this is contract
employment, and as such, only public liability for civil rights
violations shall be provided by the City for 20 part-time and 6
full time officers. Any other insurance and taxes are to be paid
and handled by the Posse.
