RESOLUTION NO. 221-91
A RESOLUTION AUTHORIZING A SETTLEMENT OF A
SEWER BACK-UP CLAIM BY STANLEY D. SULLINS OF
1210 S. DUNCAN.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors hereby authorize
payment of settlement in the maximum amount of Two Thousand Five
Hundred Dollars ($2,500.00) for a sewer back-up claim by Stanley D.
Sullins of 1210 S. Duncan. A copy of the claim is attached hereto
marked Exhibit "A" and made a part hereof.
PASSED AND APPROVED this 3rd day of December , 1991.

Mr. Sullins has provided us with a list of claims which are as
follows:
1. Hardwood floors, sanding only
2. Vinyl tile, materials and labor
3. Sheet vinyl, materials and labor
ESTIMATED COST:
$ 1744.00

(This does not include the cost of removal of the existing material
or if this is not done, re -decking these areas.)
ESTIMATED COST:
4. Complete cleaning of the furnace unit. -$ 200.00
5. Replacement of the moisture barrier beneath the house.- 1000.00
$ 1200.00
TOTAL ESTIMATE COSTS OF CLAIM - $ 3,936.17
The staff feels that Mr.Sullins claims are unreasonable and exceeds
the limit of reimbursement set by City policy.
The staff would like to make the following recommendations:
In addition to the expenses of cleaning and sanitizing the house
and Mr.Sullins motel expenses, which have already been paid.
TOTAL COSTS:
Clean and Sanitize house and furniture - $ 755.00
Motel accommodations - 215.00
$ 970.00
We feel that in this case the City should follow the
recommendations made by the Bexley Claims Service and pay for the
sanding of the hardwood floors and allow $ 300.00 toward the vinyl
flooring.
The Bexley Claims Service's recommendation for floor repairs were:
* Sanding of hardwood floors -
* Appearance damage to vinyl floors -
