RESOLUTION NO. 207-91
A RESOLUTION GRANTING AN ACCESS EASEMENT
ACROSS CITY OWNED PROPERTY ADJOINING LOT 48 OF
THE CLEAR CREEK ACRES SUBDIVISION.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby
authorized and directed to execute an access easement for property
owned by the City adjoining Lot 48 of the Clear Creek Acres
Subdivision as requested by the owner. A copy of the easement
authorized for execution hereby is attached hereto marked Exhibit
"A" and made a part hereof.

EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That the City of Fayetteville, Arkansas, a municipal
corporation, hereinafter referred to as GRANTOR, for and in
consideration of the sum of ONE DOLLAR ($1.00) and other good and
valuable consideration paid by Pat H. Burnett and Lu N. Burnett,
husband and wife, the receipt of which is acknowledged, does hereby
grant, bargain and convey unto the said Pat H. Burnett and Lu N.
Burnett, husband and wife, hereinafter referred to as GRANTERS, and
unto their heirs and assigns, an easement for ingress and egress,
being situated in Washington County, Arkansas, and more
particularly described as follows, to -wit:
A part of the Northwest Quarter of the Southwest Quarter of Section
Eighteen, Township Seventeen North, Range Twenty-nine West in
Washington, County, Arkansas, being more particularly described as
follows:
Commencing at a point which is North 00° 00' 30" East 1211.84 feet
of the Southeast corner of said forty acre tract; thence South 80°
51' 45" West 50.14 feet to the West right-of-way of State Highway
265; thence along said right-of-way North 19° 56' 15" West 30.11
feet; thence leaving said right-of-way North 80° 51' 45" East 57.49
feet; to the West property line of Lot Forty-eight in the Clear
Creek Acres Subdivision to the City of Springdale, Washington
County, Arkansas; thence along said property line to the POINT OF
BEGINNING, containing in all 0.04 acres, more or less.
This document authorized and executed pursuant to a resolution of
the Fayetteville City Board on the Shy day of 19 1(
This Easement is declared to and does inure to the benefit of the
GRANTEES and unto their heirs and assigns forever. And the said
City of Fayetteville, Arkansas, a municipal corporation, hereby
covenants with the said GRANTEES that it is lawfully seized of said
land and premises, and it will forever warrant and defend the title
to said land against all legal claims whatever.
IN TESTIMONY WHEREOF, the name of the GRANTOR is hereunto
affixed by its Mayor and its seal affixed by its City Clerk, this
