RESOLUTION NO. 191-91
A RESOLUTION AWARDING BID #91-56 FOR THE
FULBRIGHT EXPRESSWAY TREE PLANTING GRANT TO J
BAR M LANDSCAPING, COUNTRY HERITAGE
LANDSCAPING, INC., AND WESTWOOD GARDENS, INC.
AND APPROVAL OF A BUDGET ADJUSTMENT IN THE
AMOUNT OF $28,800.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby
authorized to execute contracts with J Bar M Landscaping, Inc. in
the amount of $8,790.00, Country Heritage Landscaping, Inc. in the
amount of $11,045.00, and Westwood Gardens, Inc. in the amount of
$8,965.00 to plant trees along the Highway 71 Bypass using the
funds from the Fulbright Expressway Tree Grant. A copy of the
contracts authorized for execution hereby are attached hereto
marked Exhibit "A" and made a part hereof.
Section 2. That the Board of Directors hereby approves a
budget adjustment in the amount of $28,800 00 from the State
Grants, Acct. No. 971-971-4-302.00 into Tree Planting Grant, Acct.
No. 971-230-5-385.01. A copy of the budget adjustment is attached
hereto and made a part hereof.

Negotiation to amount of Fulbright Expressway Tree Grant
The following changes were made and agreed upon for section I as
follows:
1. The quantity of Deciduous Holly was reduced from 10 to 5.
2. The Improved Shortleaf Pine will be substituted with
White Pine and the quantity reduced to 11.
3. The American Holly will be in 7 gal containers instead of
ball & burlapped and will have a 2'spread.

CONTRACT FOR FULBRIGHT EXPRESS TREE PLANTING PROJECT
This agreement made this 18th day of October, 1991, by and
between Westwood Gardens Inc., 4102 Wedington Drive, Fayetteville,
AR 72701, hereinafter called "Contractor" and the City of
Fayetteville, hereinafter called "City" shall be utilized to
provide the following:
The Contractor hereby agrees to provide trees and all
necessary services for planting and care of trees in Section I,
including, but not limited to labor, materials and equipment for
the City in accordance with the bid documents and specifications in
Bid 91-56, total amount of compensation "not to exceed" $8,965.00.
This project is to be considered a "turn key" job and shall include
all items and provisions set forth in the bid specifications
attached hereto and made a part hereof.
Project time frame shall coincide with the time schedule
stated in the bid documents. Liquidated damages of $50 per day
shall be assessed at the option of the City, and not a penalty,
beginning on the first day following the completion time entered on
this bid.
This contract may be terminated by the City by giving the
Contractor written notice ten days before termination date at
address specified by the Contractor on the bid.
If the bid exceeds $10,000, the Terns and Standard Conditions
of the City of Fayetteville expressed in item 19.A/B/C shall be
considered a binding part of this agreement and shall be provided
by the Contractor.
Invoices will be submitted to the City's Horticulturist for
approval and submission to accounts payable. Payments will be made
thirty (30) days after receipt of invoice.

72703, hereinafter called "Contractor" and the City of
