RESOLUTION NO. 144-91

1 A RESOLUTION ADOPTING CONDITIONS OF
ORDER OF THE ARKANSAS STATE HIGHWAY AND
TRANSPORTATION DEPARTMENT FOR THE CONSTRUCTION
OF APPROXIMATELY 0.75 MILES OF HIGHWAY TO
EXTEND COMMERCE DRIVE WESTWARD TO HIGHWAY 156.
WHEREAS, the Arkansas State Highway and Transportation
Department has issued a Minute Order attached hereto authorizing
proceeding with the surveys, plans and constructions as funds
become available for approximately 0.75 of highway to extend
commerce westward to Highway 156 and;
WHEREAS, the City of Fayetteville, Arkansas wishes to avail
itself of the provisions of such minute order to promote economic
development and specifically to attract and serve a new company, K-
D Tools, which will be located in the Fayetteville Industrial Park.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors hereby affirms to
the following in order to effectuate the minute order of the
Arkansas State Highway and Transportation Department:
a) K -D Tools, Inc. has made a final decision to
locate at the Fayetteville Industrial Park;
b) The city is able to furnish 20% of the cost of
engineering and construction due to grant
agreement #EIF8866 from the AIDC;
c) The city will be responsible for all right-of-
way and utility adjustments;
d) The city will accept the responsibility of
maintaining the route following the
construction of the project.
A copy of the minute order authorized for execution hereby
is attached hereto marked Exhibit "A" and made a part hereof.
