HomeMy WebLinkAbout13-91 RESOLUTION.a RESOLUTION NO. 13-91 A RESOLUTION AUTHORIZING THE AWARD OF BID NO. 90-69 IN THE AMOUNT OF $79,335.00 FOR A FIRE DEPARTMENT RESCUE UNIT. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the Mayor and City Clerk are hereby authorized and directed to execute a contract with Bridgers Coach Company of Newport, Arkansas in the amount of $79,335.00 for a Fire Department Rescue Unit. The Contractor at his own cost and expense shall furnish all labor, materials, supplies, machinery, equipment, tools, supervision, bonds, insurance, tax permits, and all other accessories and services necessary to construct a rescue unit in accordance withplans and specifications attached hereto and made a part hereof, as stated in CONTRACTOR'S PROPOSAL, and in accordance with plans and specifications attached hereto and made a part hereof under Bid /90-69, all included herein as if spelled out word for word. 2. The City shall pay the Contractor the total lump sum of ($79,355), Seventy -Nixie Thousand, Three Hundred, Fifty -Five and No/100 upon completion of all work called for in the plans and specifications. This dollar amount includes cafeteria option numbers 1, 2, 3, 7, and 8 as indicated in contractor's Proposal, a cost upcharge of $960 far an 11,000 lb GVW front axle rating. Said consideration shall be payable to the Contractor upon jab completion and acceptance by the City. , The Contract documents which comprise the contract between the City "and: tha' ContractoC consist of .=this --Contract -,and _them following documents attached hereto: A. Bid form identified as invitation to Bid 90-69 with the speoifications and conditions typed thereon. B. The Contractor's proposals attached thereto identified as Rescue Type Fire Apparatus, Hid 90-69. C. The Notice to Prospective Bidders and the Bid Tabulation marked City of Fayetteville, Rescue Type Fire Apparatus, 2:00 P.M.,. Sanuary 4, 1991, to be awarded by the Fayetteville City Board of Directors at the February 5, 1991, regular board meeting. • • • 5. 10.dill y 1 VIV VweI •r. •' v. auy • ..v 4. These Contract documents constitute the entire agreement between the City and the Contractor and may be modified only by a duly executed written instrument signed by the City and the Contractor. 5 Contractor shall not assign his duties under. the terms of this agreement. 6. Contractor agrees to hold the City harmless and indemnify the City, against any and all claims for property damage, personal injury or death, arising from Contractor's performance of this contract. 7. The actual notioe to proceed will beissued by the - Fayetteville —Fire=Department—with_.an-accompanying:_purchase , order. • 8. Contractor agrees to begin work within ten (10) days after receipt of the chassis and "Notice to Proceed" and to complete the work within 90 calendar days thereafter.. 9.
