BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE,.ARKANSAS: y Section 1. That the Mayor and City Clerk are hereby authorized and directed to' execute a contract in the amount of $124,000.00 with MCGoodwin, Williams & Yates for services in connection with the preparation of plans and specs for sewer line rehabilitation in the White River Watershed area. A copy of the contract authorized for execution hereby is attached hereto marked Exhibit "A" and made a part hereof._, PASSED AND APPROVED this 16th day of July , 1991. ;i ATTEST: ¶ 1` APPROVED: By:/1/ r— Mayor AGREEMENT FOR ENGINEERING SERVICES Sewer System Rehabilitation Fayetteville, Arkansas HIS AGREEMENT, entered into this I(p 7 day of , 1991, by and between the City of Fayetteville, Arkan as,°hereinafter referred to as the "Owner," and the engineering firm of McGoodwin, Williams and Yates, Inc., Consulting Engineers of Fayetteville, Arkansas, hereinafter referred to as the "Engineer," WITNESSETH THAT: WHEREAS, the Engineer has conducted a sewer system study of the White River Watershed portion of the Owner's sanitary sewer system; and WHEREAS, the Engineer has prepared a Phase III report dated February, 1991, for Minisystem 2; and WHEREAS, it was recommended in the report that the needed sewer system rehabilitation be accomplished in three phases, with Phase 1 to be done in 1991; and WHEREAS, the Owner desires to complete the Phase 1 rehabilitation as recommended and desires to employ the Engineer to provide the needed engineering services; NOW THEREFORE, in consideration of the mutual covenants and agreements herein contained, the Owner and the Engineer, the parties hereto, stipulate and agree that the Owner does hereby employ the Engineer to perform the required engineering services as hereinafter set out and the Engineer agrees to provide said services. Section I. Scope of the Project The project as contemplated by the Owner consists of all work recommended to be completed in Phase 1 of Minisystem 2 rehabilitation, as set out in the Phase III report for this. minisystem, except repair of private service lines. Section II. Scone of Engineering Services The Engineer shall provide a suitable engineering staff to complete the necessary studies and field surveys, to perform detailed design, to prepare plans and specifications, to provide needed services during construction of the project, and to provide other services as may be directed by the Owner. The staff shall consist of engineers, engineering technicians, inspectors and other assistants as may be necessary to carry on the work in an efficient and expeditious manner. The Engineer will provide the following services: A. Detailed Design and Preparation of Construction Plans and Specifications 1. As recommended in the report, consider rehabili- tation methods available for use on the project, develop additional data, and recommend specific methods to be used at various project locations. Upon concurrence by the Owner in specific rehab methods, perform the field surveys required to design the project and prepare construction plans and specifications. Prepare final detailed design for the project. 3 Prepare detailed construction specifications and drawings. 4. Prepare detailed cost estimates of the authorized construction. The Engineer shall not be required to guarantee that these estimates will not be exceeded by the bids received for the work. 5. Establish the scope of any soil investigations, special surveys or testing which, in his opinion, may be required for design and arrange with the Owner the conduct of such investigations and tests (costs of such tests to be borne by the Owner). 6. Furnish to the Owner, where required by the circumstances of the assignment, the engineering data (including construction plans and specifications) necessary for applications for routine permits and approvals by local, state and federal authorities. It should be noted that it was recommended that certain line segments not accessible during the study be televised and repaired. It is hereby understood and agreed that televising of these line segments is not included as part of this contract. However, it is anticipated that the televising of these line segments will be done; as part of the rehabilitation contract. The Engineer will provide supervision of this work as set out under Section C (Construction Services) below. B. Bidding and Preconstruction Services The Engineer will prepare and distribute advertisements for bids, communicate with bidders as required, provide technical interpretation of the plans and specifi- cations, conduct a prebid conference, if required, to provide information to all bidders, prepare addenda as required, attend the bid opening, tabulate bids, provide an engineering analysis of the bids received, make recommendations concerning award of construction contract(s) and assist in the preparation of contract documents. Bid tabulations and supporting documents will be prepared and submitted to the Owner. Construction Services 1. Attend the preconstruction conference scheduled by the Owner. 2. Furnish professional engineers to makeperiodic visits to the site (as distinguished from the services of a resident Project Representative) to observe the progress and quality of the executed work and to determine in general if the work is proceeding in accordance with the contract documents. In performing these services, the Engineer will endeavor to protect the Owner against defects and deficiencies in the work of the contractor; but he cannot guarantee the performance of the contractor, nor be responsible for the actual supervision of construction operations or for the safety measures that the contractor takes or should take. 3. Furnish the services of resident Project Representatives and other field personnel for on - the -site observation of construction and for the performance of required construction layout surveys. The authority and duties of such resident Project Representatives are limited to examining the material furnished and observing the work done and to reporting their findings to the Engineer. The Engineer will use the usual degree of care and prudent judgment in the selection of competent Project Representatives, and the Engineer will use diligence to see that the Project Representatives are on the job to perform their required duties. The required construction layout surveys will include the establishment of baselines for locating the work, with a suitable number of bench marks for site elevation references as shown in the plans and specifications. 4. Consult with and advise the Owner; issue all instructions to the contractor requested by the Owner; and prepare routine change orders as required. • • 5. Review samples, catalog data, schedules, shop drawings, laboratory, shop and mill tests of material and equipment and other data which the contractor submits. This review is for the benefit of the Owner to insure general conformance with the design concept of the project and general compliance by the contractor with the information given in the contract documents. It does not relieve the contractor of any responsibility such as dimensions to be confirmed and correlated at the job site, appropriate safety measures to protect workers and the public, or the necessity to construct a complete and workable facility in accordance with the contract documents. 6. Provide necessary inspection of the televising of those line segments required to be televised by the contractor. Analysis of the data obtained and recommended methods of repair will be made. 7 Prepare and verify monthly and final estimates for payments to the contractor and furnish to the Owner any necessary certifications as to payments to contractors and suppliers; assemble written guarantees which are required by the contract documents. 8. Attend, in company with the Owner's represent- ative, a final inspection of the project. This inspection will be for conformance with the design concept of the project and compliance with the contract documents. Approve in writing final payment to the contractor. 9. Furnish to the Owner documentation of the rehabilitation completed at the various locations. Additional Services 1. As directed by the Owner, the Engineer will provide assistance in securing the necessary interest in lands and rights-of-way. This work may include securing property descriptions, surveys, and easement preparation. 2. The Engineer will provide other services not specifically set out under the above scope of work, if required, and as directed by the Owner and mutually agreed to by the Engineer. a .> Section III. Payment In consideration of the performance of the foregoing services by the Engineer, the Owner shall pay to the Engineer compensation as follows: A. For work set out under Sections II -A and II -B, a lump sum amount of $61,000. This fee will be payable in four installments to be due on the following schedule: three monthly payments in the amount of $18,000 commencing 30 days after authorization to proceed and one final payment in the amount of $7,000 after bids have been received and construction contracts are ready for execution. B. For services during construction, payment shall be based on actual time required to perform the work by the various classifications of employees at the following established hourly rates plus a lump sum fixed fee in the amount of $10,500 and reimbursable expenses. The estimated cost for engineering services during construction, based on the established hourly rates, is $52,500. Payment to be made monthly and to include all costs accrued plus a pro rata share of the fixed fee. It is understood and agreed that this above fixed fee does not cover unforeseen contingencies such as default by the contractor, litigation, or other events not normally anticipated. In this event, the Engineer will be compensated for additional time at the above established rates times a multiplier of 1.2. 4 - The reimbursable expenses for which the Engineer will be reimbursed shall include travel expenses when traveling outside Northwest Arkansas in connection with the project, rental expenses for special equipment needed for completion of the work, purchase of material, and other expenses directly attributable to the project, including any work performed by subcontractors. The Engineer shall charge the Owner for reimbursable expenses at actual cost plus twelve percent (12%). C. Section II -D provides for additional services, including assistance in securing the necessary interest in lands and rights-of-way. Compensation for this work will be at the rates established in Section III -B above times a multiplier of 1.2, plus reimbursable expenses. Payment for engineering services under this agreement shall be made within 30 days after claim submittal by the Engineer. If any of the work designed or specified is suspended for an extended period of time or abandoned as a result of orders from the Owner, the Engineer shall be paid for work actually completed; payment to be based insofar as possible upon the fees established herein. Section IV. Owner's Responsibilities In connection with the project, the Owner's responsibilities shall include, but not be limited to, the following: A. Giving thorough consideration to all documents presented by the Engineer and informing the Engineer of all decisions within a reasonable time so as not to delay the work of the Engineer. B . Making provision for the employees of the Engineer to enter public and private lands as required for the Engineer to perform necessary surveys and investigations. C. Obtaining the necessary lands, easements and rights- of-way for the construction of the work. All costs associated with securing the necessary land interests, including easement preparation, surveys, appraisals and abstract work, shall be borne by the Owner. D . Furnishing the Engineer such plans and records of construction and operation of existing facilities, or copies of same, bearing on the proposed work as may be in the possession of the Owner. Such documents or data will be returned upon completion of the work or at the request of the Owner. E . Paying the costs of making necessary soundings, borings, analyses of materials and laboratory work. F. Paying all plan review costs and all costs of advertising in connection with the project. G . Providing legal, accounting and insurance counseling services necessary for the project, legal review of the construction contract documents and such auditing services as the Owner may require. H . Furnishing permits and approvals from all governmental authorities having jurisdiction over the project and others as may be necessary for completion of the project, including all local or city licenses and permits. I. Obtaining construction bids from contractors for work relating to the project and bearing all costs relating thereto. J. Giving prompt written notice to the Engineer whenever the Ownerobservesor otherwise becomes aware of any defect in the project or other event which may substantially alter the Engineer's performance under this Agreement. K . Providing fire department and police department assistance when necessary for public safety. L . Locating and exposing any or all manholes as required prior to initiation of the field work by the Engineer. M. Providing any information related to the existence of known safety hazards in the wastewater collection system andclearing the system of the hazards sufficiently to allow safe access by the Engineer's personnel. All drawings, specifications and documents prepared by the Engineer under this contract shall become the property of the Owner, to be used by the Owner for construction purposes, upon payment of the consideration due the Engineer hereunder. The Owner shall not be restricted in his subsequent use of said documents. However, the Engineer shall bear no responsibility for such re -use unless specifically agreed to in writing. THIS AGREEMENT shall be binding upon the parties hereto, their partners, heirs, successors, administrators and assigns; and neither party shall assign, sublet or transfer his interest in this agreement without the prior written consent of the other party hereto. 7 • IN WITNESS WHEREOF, the Owner has caused these presents to be executed in its behalf by its duly authorized representatives, and the said Engineer by its duly authorized representatives, and the parties hereto have set their hands and seals on the date heretofore set out. (the Engineer), entered into a contract to provide for the engineering services required in connection with Phase 1 of Minisystem 2 sewer system rehabilitation, as set out in the Phase III report for this minisystem; and WHEREAS, it is now necessary to amend the agreement to provide for additional work and to increase engineering fees accordingly; NOW THEREFORE, in consideration of the mutual covenants and agreements herein contained, the Owner and the Engineer, the parties hereto, stipulate and agree that the "Agreement for Engineering Services - Sewer System Rehabilitation" dated July 16, 1991, is hereby amended in the following particulars: A. Section I, the lining line on or "Scope of the Project," is amended to add of approximately 4,000 linear feet of sewer near Dickson Street. B. Section III, "Payment," is amended as follows: 1. For work under Sections II -A and II -B (i.e., preparation of plans and specifications and bidding and preconstruction services), the lump sum amount of $61,000 is hereby increased to $62,800. 2. For services during construction,the lump sum fixed fee of $10,500 and the estimated cost for services during construction of $52,500 (based on hourly rates for employee time) are hereby increased to $11,400 and $57,500 respectively. All other provisions of the agreement dated July 16, 1991, remain in full force and effect. Also attached is a copy of the original engineering contract approved by the Board in July of 1991 and a copy of my memorandum of February 27th on the Dickson Street Rehabilitation. Please let me know if it is decided that this item should go to the Board of Directors. • FAYETTEVILLE THE CITY OF FAYETTEVILLE, ARKANSAS • DEPARTMENTAL CORRESPONDENCE TO: Kevin Crosson, Public Works Director FROM: City Engineer SUBJECT: Water and Sewer Lines Dickson Street DATE:/February 27, 1992 The Engineering Staff has evaluated the water and sewer lines in Dickson Street as they relate to the proposed overlay and improvements. We worked with Don Cochran during our evaluation process and he agrees with the findings and recommendations which follow: SEWER LINES: The results of the sewer study completed by McGoodwin, Williams, and Yates indicate that most of the existing sewer lines in Dickson Street are in need of rehabilitation. It is estimated that the cost of rehabilitation utilizing an "in-place" type of construction is about $215,000 for approximately 3500 feet of sewer line and 64 services. This turns out to be in the neighborhood of $60/foot. We have the money available to do the needed rehab in this year's budget. This year's budget, including a roll forward from 1991, has approximately 2.5 million dollars for sewer rehabilitation. The method of rehabilitation is called "Insituform" and involves lining the existing sewers without the need for any digging at all. The method is a proprietary one and therefore we would receive only one bid on the job. This is somewhat of a concern, however, considering the alternative of conventional replacement of the lines (open cut) this may well be the least expensive way to go. I have attached a rough cost estimate based on some previous replacement jobs. Even if we could do the open cut a bit less expensively than the Insituform, I believe we would make up that difference in convenience to the general public and the speed of construction. The Sewer crews would televise each sewer service line and replace or repair any that need it. Also the Sewer Maintenance crews would rehabilitate all manholes. • WATER LINES: Based on our physical investigations of the existing water lines in Dickson Street we are recommending that we do not replace any lines at this time. The lines are old cast iron lines and have the old lead joints, however, our investigations show the lines to be in excellent condition with no signs of corrosion. The Water Maintenance Division will, however, replace all of the existing galvanized service lines in Dickson Street prior to any construction. It is my recommendation that we proceed as indicated above. The specific recommendations are: 1. Include the sanitary sewer rehabilitation in the sewer rehab contract currently being put together by McGoodwin, Williams, and Yates. The rehab method recommended is Insituform, 2. Replace or repair individual sewer services using in-house crews, 3. Rehabilitate sewer manholes as required with in-house. crews, 4. Leave existing water lines in place, but with replacement of galvanized service lines by in-house crews. COST COMPARISON INSZTUFORM VS.
