WITH REPUBLIC_PARKING SYSTEM OF CHATTANOOGA,
TENNESSEE FOR PARKING AT THE AIRPORT TERMINAL

BE IT. RESOLVED BY THE ,BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section a. That the Mayor and City Clerk are hereby
authorized and directed to execute the lease modification with
Republic Parking System of Chattanooga, Tennessee for parking at
the Airport Terminal Building. A copy of the lease modification
authorized for execution hereby is attached hereto marked Exhibit
"A" and made a part hereof.

MODIFICATION TO LEASE
REPUBLIC PARKING SYSTEM OF CHATTANOOGA, TN
This AGREEMENT made this
1991, by and between the
hereinafter called "Lessor"
hereinafter called "Lessee".
2nd day of July
City of Fayetteville, Arkansas,
, and Republic Parking System,
WHEREAS, Lessor and Lessee entered into a Lease Agreement
hereinafter called "Lease", dated April 17, 1990 for a five year
lease term commencing October 1, 1990, and
WHEREAS, the parties desire to modify the aforesaid Lease
Agreement to capture a large potential revenue source and provide
a service to the public which will alleviate the need for an
Airport Shuttle Service,
NOW THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS:
1 Paragraph 10 of the Lease shall be deleted entirely and the
following shall be inserted in its stead:
(10) The parking rates shall be charged in accordance
with the following schedule:
SHORT TERM:
0 to 30 Minutes
Each Additional 30 Minutes
Maximum per 24 Hours

0 to 1 Hour $1.00
Each Additional Hour .50
Maximum Per 24 Hours 3.75
MONTHLY PARKING PERMIT :
Per Month $30.00
(payable quarterly in advance)
Parking rates shall not increase or decrease without a
written request by Operator and written consent by the
Airport Manager. Such consent not to be arbitrarily
withheld.
A maximum of 120 monthly parking permits may be issued.
A cap is set to assure sufficient space remains available
for general public use.
2. The Lease is modified by adding the following:
(33) Republic Parking System agrees to provide one uniformed
person hereinafter referred to as a "Curb Attendant" to
help control vehicle parking in loading/unloading areas
and in no parking areas. Duties shall include information
to the public regarding time limits for loading/unloading
areas, general parking information, freight parking
information, directions for baggage handling, warnings of
violations, the towing of violators pursuant to
instructions provided by the Airport Manager and general
information.
Said Curb Attendant shall be an employee of Republic
Parking System and shall be compensated directly by the
Lessee. The Lessor shall establish the number of hours
and the work schedule to be provided by the Curb
Attendant with the concurrence of -the Lessee. The hours
can be modified to facilitate fluctuating aircraft
schedules. A time sheet will be submitted monthly with
the percentage payment to the Lessor. Said time sheet
shall enumerate the dates and hours worked for that
compensation period! The total hours for each monthly
period will be multiplied at a rate of $6.00 per hour,
and that amount will be deducted from the rent payable to
the City for said monthly period. The compensation rate
may be adjusted by;mutual consent by and between both
parties.
The City retains complete scheduling authority over the
Curb. Attendant and will only be responsible for payment
of approved, signed, scheduled hours which are completed.
The City will provide sufficient heated and cooled
waiting areas inside the entrances of the Terminal
Building for the Curb Attendant.
The usage of a Curb Attendant is at the sole discretion
of the City and the City may terminate the use of said
Attendant if it deems said employee unnecessary for any
reason, e.g., the education of the public to parking
policy to the extent that strong enforcement measures are
no longer necessary, loss of traffic, cost of enforcement
verse benefit, etc.
Providing a Curb Attendant may be discontinued by
Republic Parking System by giving the City thirty (30)
days written notice:
It is completely understood by both parties that the Curb
Attendant has no ticketing or arrest authority.
3. In all other respects, the original agreement is hereby
republished and affirmed.
IN WITNESS WHEREOF, the parties have executed this
Modification of Lease on the day and year first above written.

This AGREEMENT made this 1st day of October, 1996, by and between the City of
Fayetteville, Arkansas, hereinafter called "Lessor", and Republic Parking System, hereinafter
called "Lessee"
WHEREAS, Lessor and Lessee entered into a Lease Agreement hereinafter called
"Lease", dated April 17, 1990.
WHEREAS, the parties desire to modify the aforesaid Lease Agreement:
NOW THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS:
Paragraph 10 (33)
Total hours for each monthly, period deducted from the rent payable to the City for Curb
Attendant will be increased from a multiplied rate of $6.00 per hour to a multiplied rate of $6.60
per hour. This change is due to the increase in federal minimum wage effective October 1, 1996.
In all other respects, the original agreement is hereby republished and affirmed..

Dear Dale:
The federal minimum wage increases to $4.75 per hour effective October 1, 1996. Our
agreement to provide curb attendants was based on a wage rate of $4.25 per hour. I
respectfully request that effective October 1, we be allowed to adjust our per hour fee to
$6.60 per hour up from $6.00 per hour.\sThis will keep us whole white maintaining the
curb enforcement which has helped the traffic congestion and increased the parking
revenues.

me.
