A RESOLUTION ACCEPTING THE SETTLEMENT OFFER OF
$7,500.00 FROM BURLINGTON NORTHERN RAILROAD
FOR PROPERTY OBTAINED BY EMINENT DOMAIN
PROCEEDINGS FOR A STREET RIGHT-OF-WAY ALONG
NORTH STREET.
BE IT .RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors hereby authorize
the City .Attorney's Office to .accept the settlement offer of
$7,500.00 -for property obtained for a street right-of-way in
eminent domain proceedings owned by Burlington Northern Railroad.
A. copy of the authorized for execution hereby is attached hereto
marked Exhibit "A" and made a part hereof.

PROPERTY OWNED BY BURLINGTON NORTHERN RAILROAD

May 7, 1991, the Board of Directors passed and approved
Ordinance No. 3548, authorizing eminent domain proceedings for the
City to obtain street right-of-way, utilities and sidewalk
easements on property located along North Street, owned by
Burlington Northern Railroad, Inc.
May 10, 1991, a Complaint in Law was filed in the Circuit
Court of Washinton County; an Order of Possession was entered; and
$6,150.00 was deposited with the Court as the City's best estimate
of just compensation for the easements taken. Subsequently,
negotiations were conducted and we have an offer to settle from
Burlington Northern Railroad for $7,500.00, subject to the Board's
consideration and approval.
I would -request this be added as a board agenda item for the
June 18, 1991 meeting. Upon the Board's approval, the proper
documents will be prepared and presented to the Court.
