A RESOTUTTON AWARDING BID #90-16 TO WEINLAND.
INC. OF CANTON, OHIO FOR A T -HANGAR STORAGE
FACILITY AND APPROVAL OF A BUDGET ADJUSTMENT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby
authorized and directed to execute a contract with Weiniand, inc.
of Canton. Ohio for 13 unit T -hangar storage facility in the
amount of $143.156. A copy of the contract authorized for
execution hereby is attached hereto marked Exhibit "A" and made a
part hereof.
Section 2. That the Board of Directors hereby approves
the budget adjustment in the amount of 532,075. A copy of the
approved budget adjustment is attached hereto marked Exhibit "B"
ana made a part hereof.

IN -YEAR SUPPLEMENTAL BUDGET REQUEST
CITY OF FAYETTEVILLE, ARKANSAS

CONTRACT
This Contract executed this 15th day of may
1990, between the City of Fayetteville, Arkansas, hereinafter called
the City, and Weinland, Inc., hereinafter called the Contractor.
In consideration of the mutual covenants contained herein, the
parties agree as follows:
1. The Contractor shall construct one 13 -unit metal prefabricated
T -hangar on the east side of the Fayetteville Municipal Airport (Drake
Field) in accordance with contractor's proposal dated April 4,
1990, as modified hereby. The Contractor shall Ldh.nence work within
5 calendar days from receipt of a notice to proceed issued by the
City and shall complete construction within 120 calendar days (excluding
Saturdays, Sundays, national or state holidays and rainy days as eviden,.:ed
by Contractor's daily log) after receipt of said notice to proceed.
Time is expressly made of the essence of this contract. In the event
construction is not cat(pleted within the time prescribed hereby, the
Contractor shall pay the City the sum of $150.00 per day as liquidated
damages, and not as a penalty, for each day beyond said 120 day period
construction is not completed.
2. The Contractor shall provide all equipment, tools, labor,
and materials required for the construction of the above-described
project.
3. The City shall pay the Contractor a total sum of $143,156.00
(which price reflects the eliminati-n of interior walls) for completion
of the above-described work.
4. The Contract documents which comprise the contract between
the City and the Contractor consists of this Contrac` and `re `ollowing
documents which are incorporated herein and made a part hereof by
reference thereto:

C. Interior Electrical Plan
9. Bidder's 5% Bid Bond
5. The Contract documents constitute the entire agreement between
Ci -y and the Contractor and may be modified only by a duly executed
written instrument signed by the City a -d the Contractor.
6. The Contractor shall not assign his duties under the terms of
this agreement.
7. The Contractor agrees to hold the City harmless, and Indemnify
the City,
or death,
against any and all claims for property damage, personal injury
arising from Contractor's performance of this Contract.
