A RESOLUTION A:JTHORIZING THE PAYMENT OF A
$10,000 FINE TO THE UNITED STATES
ENVIRONMENTAL PROTECTION AGENCY AND APPROVAL
FOR THE MAYOR TO SIGN THE CONSENT AGREEMENT
AND APPROVING A BUDGET ADJUSTMENT.
BE TT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF

Adopted as an official policy resolution by the United States Conference of Mayors
June, 1989

WHEREAS, in the past 19 years since Earth Day, 1970 (when most Americans learned
the meaning of the term "environment") the health of the environment has
continued to decline; and
WHEREAS, at the current rate of consumption, 80% of all the oil that will ever be
burned will have been used during the lifetimes of people who are now alive: and
WIIEREAS, we are more than ever a throwaway society, discarding about 5 pounds of
garbage per person per day; and
WHEREAS, we are adding millions of tons of hazardous wastes to the environment
every year with 2.4 billion pounds of toxics pumped into the air in 1988 alone; and
WIIEREAS, most scientists now agree that, because of the increasing proportion of
carbon dioxide and other gases in the atmosphere, significant global warming will
occur which may have serious consequences to many forms of life - a problem which
will become even more severe with continued growth; and
WHEREAS. the emiss:on of CFCs into the atmosphere has led to a dangerous 40 percent
drop in the Antarctic ozone level, creating increased radiation and seriously
impacting all forms of life including human beings; and
WIIEREAS, toxic air emissions are reducing the pH levels of lakes around the nation,
resulting in the destruction of many aquatic species; and
WHEREAS. because all of these problems are a result of inefficiency and waste, the
solutions to the problems will promote economic efficiency and economic growth;
and
WHEREAS, there are many opportunities open to local government to address these
critical problems;
NOW. THEREFORE, BE IT RESOLVED that the following Declaration of Environmental
Rights and Responsibilities is hereby adopted in recogni,lon of Earth Day. 1990, along
with a statement of commitment by local governments to implement programs
designed to protect these environmental rights and meet these responsibilities:
ENVIRONMENTAL RIGHTS
All human beings have the right to clean and healthful air, to clean and healthful
water, to the maintenance of productive soils, and to an organization of human
activities with respect to the environment, that prevents extinction of forms of life,
the degradation .of the living and nonliving resources ..of the earth, and the
sustainability of the use of the earth's resource.s, so that .'ample re.sourees will exist
for generations to .come.
ENVIRONMENTAL RESPONSIBILITIES
In order to achiev:e the rights :declared herein, .The United .States Conferenc.e :of
Mayors recognizes the following res:ponsibilities:
1. .Local .governments„ as well a:s individuals., have the responsibility to
.contribute to solving regional and glo.b.al .environmental and material
resource problems. Lo.cal .governments :can and should adopt .programs :and
policies which conserve resources and :avoid the gen.eration of wastes which
pollute our water, land and air.
Thes.e local g.ov.emment program:s .•and policies :should .address. .at a minimum.
a. Energy conservation ..and renew.able 'energy production.
Solid waste reduction, reuse and recycling.
c. Re:duclion in the use of lazardous substances and lire reuse 'and
recycling :of hazardous wastes.
d. 'In:creased use of :ilia:5s ...transit and :the :reduction of transp.ortation needs
through improved lan:d use planning.
The United States Conference of Mayors recognizes that lite implementation .of these
programs will substantially improve lov.ernments .:ability t.o .prateet .public health
and safety .an.d prom.ote prosperity.
