A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A CONTRACT WITH THE YOU CAN
PROGRAM AND APPROVING THE UNUSED PORTION OF
THE 1989-90 CHILD CARE LOAN BE USED FOR A
SCHOLARSHIP PROGRAM.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby
authorized and directed to execute a contract with the YOU CAN
PROGRAM to pay for a full-time employee. A copy of the contract
authorized for execution hereby is attached hereto marked
Exhibit"A" and made a part hereof.
Section 2. That the Board of Directors hereby approves
the allocation of the unused portion of the 1989-90 child care
Loan for a scholarship fund program.

Sub -grant Agreement
This Agreement, entered into this 15th day of March, 1990 by and
between the Economic Opportunity Agency of Washington County,
Arkansas hereinafter called Subgrantee, and the City of
Fayetteville, Arkansas hereinafter called Grantor,
WITNESSETH:
Whereas, the subgrantee operates an anti -poverty community
action agency in Washington County, Arkansas where Fayetteville
Is located and has many requests for educational, job training
and child care assistance from residents within the city limits
of Fayetteville; and,
Whereas. the Grantor acknowledges the benefits of a program
pssisting residents to further their education, participate in
Job training, and open their own home based child care
facilities.
Now Therefore. in consideration of the benefits tc be derived
by the citizens cf Fayetteville from Subgrantee's YOU CAN!
program, Grantor agrees to furnish Subgrantee a maximum of
$36,300 for the purpose of underwriting the YOU CAN! program for
a period of twelve months in the corporate limits of the Grantor.
Continued funding for a maximum of 36 months ( a total of five
years) shall be at the sole discretion of Grantor's Board of
Directors. Said Grant shall be shall be subject to the following
conditions:

1. Conditions of Grant
All funds made available by Grantor to Subgrantee shall be
used only in Subgrantee's YOU CAN! program. The grant amount
shall underwrite administrative costs of $22,500 plus 27 and one-
half $500 stipends from $13,800 of unspent child care family home
loan money from the 1989-90 program year. Any funds received by
the EGA through repayment of loans extended to day care
participants during the first year of operation will be paid to
the city monthly.
2. Method of Payment
Payment of grant funds to Subgrantee for administrative
purposes shall be on a monthly basis to be available on April 15,
1996. The Monthly administrative amounts of $1875.00 will be
available on the fifteenth day of each month through March 14,
1991.
The education/Job training grants will come from the unspent
child care family home loan money from the 89-9C you CAN! program
year, which was disbursed to the you CAN! program as outlined by
the sub -grant agreement of the first program year,
3. Time of Performance
The term of this contract shall be twelve (12) months
commencing March 15, 1990 and ending March 14, 1991.
4. General Provisions
A. A licensed professional social worker will direct the
YOU CAN' program. This person will be directly supervised by the
Executive Director of the Subgrantee.
B . Subgrantee agrees to assist up to 35 ( as funds allow)
impoverished Fayetteville residents at or below 125% of the
current federal poverty threshold to enroll in either
vocationally oriented courses of study at pcst-secondary
institutions of higher learning or in cn-the-Jcb training
positions funded through the Job Training Partnership Act
Program. Five hundred dollar ($500) stipends plus counseling and
follow-up will be available to each participant.
C. Subgrantee agrees to establish the following
obJectIves in program administration:
- Achieve a minimum of 70% placement and retention among
participants who enroll in program as part or full-time students
during the 12 month period or segment thereof in which
matriculation in school in accomplished.
- Achieve a minimum of 70% placement retention and
completion rate among participants who enroll in program as on -
the -Job trainees. Furthermore, 70% of on -the -Job trainees will
obtain and retain unsubsidized employment or continue their
education after completion of their on -the -Job training.
D . Subgrantee agrees to limit to a maximum of four the
number of $500 education/Job training stlpends awarded to program
participants already enrolled in educational courses or on-the-
job training. All other program participants will be new
students or job trainees.
E . Subgrantee agrees to perform all follow-up necessary
to evaluate success of program. A monthly report on program
operation will be submitted to Ms. Jan Simco, City of
Fayetteville Community Development Director, Oh the 10th day
following the end of each month. PThe monthly program activity
reports will also include financial information regarding program
income and expenditures. The information will be reported in
sufficient detail to provide the City an accounting of all income
by source and expenditure by type.
F. Subgrantee will convene the YOU CAN! Advisory
Committee on a quarterly basis to review and evaluate program
progress. Minutes of these quarterly meetings will be submitted
to Jan Simco, City of Fayetteville Community Development
Director, on the 10th day following each quarterly meeting.
G. Subgrantee will establish safeguards to prohibit
employees from using positions for a purpose that is, or gives
the appearance of being, motivated by a desire for private gain
for themselves or others, particularly those with whom they have
family, business or other ties.
H. Subgrantee will comply with the provisions of the
Hatch Act which limits the political activity of employees.
1. Subgrantee will give the Fayetteville City Manager and
Comptroller through any authorized representatives access to the
right to examine all records, books, papers, or documents related
to the grant.
5. By executing this Agreement, Grantor does not waive its
statutory tort immunity under Arkansas Code Ann. Section 21-9-301
(1987).

In the Grantor and the Subgrantee have executed
this agreement on or as of the date first above written.
