Attached please find the proposed Amended Contract with the
Wheeler Water District which will allow for the installation of
fire hydrants within the district. If the Board wishes to approve
fire hydrants for the Wheeler Water District, the Amendment needs
to be _approved.

RE: Growth Area Fire Hydrant Policy
The following is the proposed general policy regarding fire
hydrants in growth areas drafted from staff proposals together
with possible advantages and disadvantages:
It is the general policy of the City of Fayetteville to
attempt to be a "good neighbor" to residents of adjoining growth
areas. Accordingly, the City will seek to assist these growth
areas in the installation and maintenance of fire hydrants on City
maintained water lines so long as the following criteria are
satisfied:
1. The growth area that benefits from the fire
hydrants must bear all costs for their
installation and maintenance. These costs
would include all initial capital costs and
continuing costs ef maintenance and
administration.
2. The lines upon which the fire hydrants are
attached must be capable of maintaining a
proper flow for fire protection.
3. That the growth areas agree and understand
that the City makes no guarantee of any
minimum capacity of flow at any given time and
agree to a disclaimer of any City liability
from damages which may result from a lack of
an adequate flow sufficient for fire
protection.
4. That the City have prior approval of the
placement and number of the fire hydrants.
5.. That the growth area have the present ability
to utilize the fire hydrants which, at a
minimum, would require a rural fire department
within the growth area.

The Staff recommends this policy be passed by the Board
replacing the old one. We feel that the policy will be more
difficult on the city staff but will be good for our neighbors.
We also fee that if the listed criteria is met we should have a
safe stituation and have our costs covered.

POSSIBLE DISADVANTAGE IN.APPROVING FIRE HYDRANT POLICY
1 Outside area could have better tire protection than
inside rhe Cirv. There are many areas inside
Fayetteville without adequate fire hydrant protection.
Greater possibility of vandalism and theft of water.
Theft of water could not be measured in these areas.
There may be extra -ordinary maintenance problems due to
misuse of hydrants.
3. Reduction of incentive of annex into the City.
4. Greater usage of an already limited amount of water.
This will reduce the amount available to citizens of
Fayetteville.
5. Network of lines in growth area is generally not good
and therefore the chanes of :reducing operating
pressures below safe levels while pulling fire flows are
greater than hormal.
6. Possible contamination by pulling water faster than
system could provide (backfidwing). System would
perhaps then pull in contamirnates from chicken -water or
other soil related contaminates. This would cause
tremendous work on the entire system.

POSSIBLE ADVANTAGES IN APPROVING FIRE HYDRANT POLICY
1. Good neighbor relations. (Fire protection, reduced
insurance rates, etc.)
2. If the City was to annex later they would not have to
pay additional costs to install hydrants.
3. Less total costs for hydrants because of .
Inflation
More difficult and expensive to place in after
line is in the ground.

RE: Wheeler Water District Fire Hydrants
After reviewing the City's Fire Hydrant Policy for Growth
Areas and recommeding major changes, we come back to the issue of
Wheeler fire hydrants.
Wheeler has obtained a grant to place fire hydrants in the
system. They are requesting that we allow this during the
construction period.
The following are staff concerns and possible solutions which
arose while discussing the Wheeler Water District fire hydrants in
the context of the proposed fire hydrant policy:
1. Staff is concerned that Wheeler Water District
may rely too heavily ot the fire hydrants for
fire protection and lead people to believe
they have protection when they do not. There
may be times when the Fayetteville system
because of drought or other conditions becomes
so stressed that the flow to Wheeler may be
temporarily cut off or cut back and there may
not be a sufficient flog to effectively fight
fires in the Wheeler District. In all candor,
staff is concerned that someone will be
seriously injured of killed as a result of
such a mistaken reliance. All the contracts
and agreements that can be written are not
sufficient to justify such a possibility.
Solutions: (1) Fully disclose to Wheeler and
encourage Wheeler to disclose to their
customers that the contract contemplates
certain situations when the flow to the fire
hydrants may not be sufficient for adequate
fire protection; (2) Obtain a formal
disclaimer from Wheeler Of any City liability;
(3) The problem should be somewhat alleviated
in three or four years when the City will add
additional transmission capacity.

contaminates. This would cause tremendous
work on the entire system.
Solutions: (1) Upgrade the major lines to
8 inch instead of 6 inch and do not allow fire
hydrants on anything smaller than a 6 inch.
(2) The problem should be somewhat better
when additional capacity is added.
3 The cost to the Wheeler Water District for the
maintenance of fire hydrants by the City is
likely to be significantly higher than for
Fayetteville residents. Distance alone
increases maintenance and inspection costs.
Incidents of vandalisffi and misuse may be
higher in isolated areas although only time
will tell for sure. In Fayetteville city
employees have the opportunity to casually
view areas daily or weekly. In more isolated
growth areas there is no such contact.
Accordingly, these may be extensive water loss
in isolated areas before it is noticed.
Solutions: (1) Charge rates sufficient to
bear such additional costs while recognizing
that, at the present time, many of the cost
concerns are based on as yet unknown
maintenance problems which may effect future
rates upward or downward
Staff recommendations: Staff has concerns about recommending the
installation of fire hydrants in the Wheeler Water District at
this time due to the problems diseussed in the items above.
Accordingly. staff would recommend that proper fittings and
connections be immediately installed in the Wheeler Water lines
for the easy installation of fire hydrants in the future, but does
not recommend the installation ef the hydrants until a more
dependable continuous year round flow can be provided to the
Wheeler Water District.

RESOLUTION NO. 43-90
A RESOLUTION ADOPTING THE GROWTH AREA FIRE
HYDRANT POLICY AS A CRITERIA TO INSTALLATION
AND MAINTENANCE OF FIRE HYDRANTS.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors adopt the Growth
Area Fire Hydrant Policy as a criteria to assist those growth
areas in the installation and maintenance of fire hydrants on city
maintained water lines. A OOpy of the policy authorized for
eXecution hereby is attached hereto marked Exhibit "A" and made a
part hereof.
