BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF F'AYE iTEV I I.LE, ARKANSAS: Section 1. That the Mayor and City Clerk are hereby authorized and directed to execute a two-year contract with Motorola Communications Et Electronics, Inc., in tne amount of 345,538.40 per year, for the :maintenance of the 800 Smartnet Radio System. A copy of the contract authorized for execution berebv is attached hereto marked Exhibit "A" and made a part hereof. PASSED AND APPROVED this 20th day of February , 1990. I have added 4 STX Portables at the same pricing, and have deleted 1 Syntor X Mobile. These Changes are retroactive to 3-2-90, and will show up on your new March invoice. Terms and Conditions A. This Service Agreement is subject to standard Motorola terms and conditions as described in Exhibit "B" attached. B . When needing service, it will be the city's responsibility to deliver and pick up mobile and portable radios at the contractor's local shop. C. All fixed equipment, including the CentraComm II, CentraComm II Slave Unit, Central Site Controller and Repeaters, and Control Stations, will be serviced at the customer's location. D . Twenty -Four (24) hour, seven (7) day per week service will be provided on fixed end equipment to include the Central Site Controller and Repeaters, the CentraComm II, and the CentraComm II Slave Unit. An authorized Motorola Representative will respond within four (4) hours of notification that fixed equipment is not operational. E . All other fixed equipment will be serviced on an 8:00 AM to 5:00 PM, Monday through Friday, basis excluding holidays. An authorized Motorola Representative will respond within eight (8) hours of notification that fixed equipment is not operational. F. Motorola will provide an average turn around time for in -shop repairs of 4 to 5 working days, excluding any shipping required. Should circumstances arise that require repairs to take longer, such as parts shipment, the appropriate coordinator for the City of Fayetteville, Arkansas, will be notified with explanation and expected completion dates. No penalty will be assessed to the contractor due to time delays in shipping parts or repair of equipment, if the contractor notifies the City of Fayetteville, Arkansas, of these delays. However, failure by the contractor to notify the City of Fayetteville, Arkansas, of any delays that would result in failure to meet time deadlines specified in this contract, will result in a 1% per day penalty of the monthly maintenance rate. G . The contractor shall provide one (1) spare Motorola Syntor X Mobile Radio to be used by Public Safety to limit downtime. H . Preventive Maintenance Inspections. Quarterly preventative maintenance inspections will be provided for the Central Site and CentraComm II Equipment. All other equipment will receive two yearly service inspections. The contractor will coordinate with the Communication's Division when the inspection is being done and will supply a list which shows the radiio serial number and time and date the radio was inspected.
