BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. Project Summary To combine three existing agencies which currently administer grants into one grant package. Additionally, to create a multi -jurisdictional task force by adding two more investigators for a total of seven full-time drug investigators to work in a concerted effort in the two county area. IGS 1 IGS 2-A EXPENDITURE JUSTIFICATION FOURTH JUDICIAL DISTRICT DTF DLEP FED '91 Proposed expenditures of federal funds for personnel, hardware, and/or equipment .as necessary and incidental to the project: PERSONNEL Major funding from DLEP will be used for personnel salary expenses. Personnel will be employed only in task force investigative projects and activities. Funds for personnel are a Critical element to meet the objectives of the program. Traditionally, law enforcement agencies in the Northwest Arkansas area have failed to sustain the long term cooperation needed to adequately support drug 'enforcement on a multi - 'jurisdictional level. For the Fayetteville Police Department, this failure has been primarily attributed to the lack of personnel in the Detective Division. Fiscal constraints have limited the number of personnel in the Detective Division. Likewise, this condition is similar in other city and county agencies in Washington and Madison counties. With such limited manpower no agency can currently maintain.a special unit devoted entirely to drug enforcement without significantly impairing other :criminal investigation responsibilities. Previous years' funding from DLEP has enabled the 4th Judicial District Rural Task Force, Springdale Police Department, and the Fayetteville Police Department, to specifically assign full-time investigators to drug enforcement efforts. This grant proposal will combine three former contracting agencies into one application and add additional agencies to the effort to create a true multi -jurisdictional task force. IGS 2-A DLEP FED '91 EXPENDITURE JUSTIFICATION FOURTH JUDICIAL DISTRICT DTF HARDWARE Materials and supplies detailed in Form IGS 2B under the categories of "Maintenance and .Operations" and "Equipment and Hardware" are broken down into individual line items. These items will be used to equip the operation with office and other supplies necessary for continued records maintenance, office administration, and other expenses associated with keeping the program operable and expanding the program to a multi-jurisdictional'program. EQUIPMENT Equipment expenditures attachments to .Form equipment items over $ are outlined in Form 2-B and detailed in 2-B. An EXPLANATION/JUSTIFICATION for 300.00 in cost follows: Radio System One difficulty the DTF will ;have is that of radio communications. With so many agencies involved and investigators from a minimum of five different agencies working together, radio communications are of a primary importance. The purchase of a radio system, possibly with a portable repeater, is planned to alleviate the problem. We plan to purchase .at minimum, one radio for each assigned investigator for a total of seven. We hope to be able to purchase a base station/movable repeater to increase system range. Longer range plans would include purchasing a few additional radios to supply other agencies with communication during a particular drug operation. Vehicle Trade-in expense In the previous years' project the Fayetteville Task Force traded -in old vehicles and purchased two (2) used vehicles for the drug project. The amount budgeted in this year's project is to again be used for trading -in vehicles and purchase of replacement used vehicles. Current vehicles will become "known" in the area before long and a changeup will be necessary. The vehicles are used by the officers for drug investigations. Funding will be provided to staff the task force with seven investigators, one secretary, and one fiscal officer. The funding will support the expense of additional offices in the existing task force office facilities in the nearby Federal Courthouse in Fayetteville (on the same floor and sharing a common wall) with the local DEA offices. Funds will be used to purchase related supplies to allow investigations to be initiated, completed, and prosecuted. The project period is February 1, 1991 through January 31, 1992. GOAL Continue operations of a multi -jurisdictional drug law, enforcement task force to remove specifically targeted major organized crime narcotics trafficking conspiracies and offenders through investigation, arrest, prosecution,. and conviction. OBJECTIVES 1. Incorporate major drug investigations in the Washington and Madison County area into a single and collective investigative effort executed by a "Control Group" of local law enforcement agencies supported with federal funding. 2.' Alleviate repetition by multiple agencies of drug investigations in the Washington County area by 50%. 3. Increase the number of arrests and prosecution of drug offenders who operate in the general Northwest Arkansas area by 25% over the last project period. 4. Increase the probability of criminal and civil forfeiture in drug convictions by 25% compared withi.the last project period. FORM IGS -3 PROJECT NARRATIVE FOURTH JUDICIAL DISTRICT DTF DLEP FED '91 CRITICAL ELEMENTS Control Group A Control Group will be organized according to DLEP rules and regulations. The Control Group will be comprised of law enforcement officers from at least 13 local and county law enforcement agencies. The lead agency will be the Fayetteville Police Department. The Control Group will follow DLEP rules and regulations and will strive to alleviate any duplicity of efforts between agencies. Each member of the Control Group will have a vote in matters before the members. Funding The Control Group will review resources needed to successfully complete investigative projects. Unit Organization The Control Group will name the Project Director, the Fiscal Officer, and the Operations Coordinator. Each of these persons have specific responsibilities. Only the Fiscal Officer and Operations Coordinator will be paid through sub -grant funds. Individual responsibilities of these individuals are further. outlined in the Intergovernmental Agreement located later in this sub -grant proposal. The Fayetteville Police Department is designated as the lead agency. Target Selection The Control Group will give guidance and make recommendations to the DTF as to individual targets for investigative projects. Special consideration will be givento the probability of a successful arrest, prosecution, and criminal and civil forfeiture. • Drug offenses will be targeted at what the Control Group determines to be the most prevalent and readily available drugs attributed to or conducive to other criminal behavior. The file will be separated into a biographic index and a location index. Drug intelligence reports will be analyzed to assess the status of criminal activity of major drug conspirators and their associates. The Control Group will identify major drug distributors and conspiracy targets based on an analysis of information and evidence located in the central file. DISTRICT - DRUG TASK FORCE INTERGOVERNMENTAL AGREEMENT The undersigned public agencies, charged; with the duty of enforcing the law and protecting their citizens from illegal activity, and recognizing that the jurisdiction and authority of each is limited arid that such limitations are detrimental in combating crime within the designated counties and among the major municipalities within said counties, and recognizing that the problem can be most effectively combated by the pooling of their resources and the joint exercise of their respective authorities; they and each of them do now enter into this Intergovernmental Agreement to provide to their citizens the most effective law enforcement protection against those who engage in actions detrimental to public safety. Parties hereby enter into the Agreement. in accordance with authority vested in them by the Constitution of the State of Arkansas and the Arkansas Rules of Criminal Procedure. PURPOSE. Purpose of this agreement is to create a multi - jurisdictional authority to be known as the Fourth Judicial District Drug Task Force. • DLEP FED '91 The Task Force will direct its primary enforcement efforts in the following areas: A. Covert and overt investigations concerning individuals engaged in illicit criminal .activities in the Fourth Judicial District Circuit area with specific emphasis on illegal controlled substances activity. B. Development of intelligence data regarding criminal activity in the area. Assimilation and maintenance of • intelligencefiles regarding such criminal activity. Disseminationof intelligence activities to the appropriate federal, state, and local law enforcement agencies. Establishment of liaison with the State Attorney's Office and the United States Attorney's Office for legal advice and encouragement of vigorous prosecution of developed cases. F. Coordination and cooperation with the DEA and FBIon cases of mutual interest. DEFINITIONS. • The term "Control Group" and "Board" are synonymous in meaning. Both refer to the representatives signing this agreement. "DTF" means Drug Task Force "Participating agency" means those agencies who employ personnel through the DTF sub -grant. "IGS" is the Intergovernmental Services division of the Arkansas Department of Finance and Revenue. DUTIES. The Board shall be responsible for the overall management of.the Task Force. Matters of policy will be determined by the Board. Each agency represented on the Board willhave one vote. A plurality vote of the total Board membership will be required for the making of any decision. The Board shall meet regularly as determined by the Board and may meet for special meetings with advance notice to the each agency represented on the Board. GRANTS. Inthe event the Board decides to apply for sub -grant funds, the Board shall designate a. lead agency and Project Director. DLEP FED '91 PROJECT. DIRECTOR. The Project Director's responsibility is to interact with the Control Group members, fiscal officer, and state drug grant officials concerning administrative affairs and other duties the Control Group may wish completed. The Project Director will oversee the preparation of the grant application. The Project Director will be responsible to follow IGS procedures, and Federal, state, and local laws concerning the administration of grant monies. The Control Group will receive periodic reports from the Project Director on progress. It is theresponsibility of the Control Group to name a Project Director. The Control Group may vote to replace the Project Director at any time.. The Project Director's position will not be a paid position within the framework of the sub -grant. FISCAL OFFICER. The Fiscal Officer will be a paid full-time position .and funded through the sub -grant. .It is the Fiscal Officer's responsibility to complete the day-to-day financial requirements of the sub -grant along with quarterly, yearly, and final reports required by IGS. The Fiscal Officer will interact with the Project Director, each of the participating agencies and IGS officials. The Fiscal Officer will set-up an accounting system and will track all sub -grant transactions. The Fiscal Officer will receive funding requests from the individual participating agencies, prepare reimbursement requests and submit_ to IGS, and.. after receipt. of funds, promptly disburse funds to participating agencies. The Fiscal Officer shall adhere to all IGS procedures, federal, state, and local laws concerning sub -grant activity. The Fiscal Officer must have proven experience and abilities in governmental accounting and purchasing procedures and familiarize themselves with all procedures and laws concerning sub -grants. It is the responsibility of the Control Group to name a Fiscal Officer. The Control Group (Board) may,with cause, vote to replace the Fiscal Officer at any time. OPERATIONS COORDINATOR. The Operations Coordinator will work at the drug investigation level. Primary responsibilities will be to hold frequent meetings with all participating agency investigators. The meetings will be held to share information and coordinate efforts of investigations. The Operations Coordinator will be responsible to track information and compile the monthly progress reports to. the State Drug Director's office. The Operations Coordinator should remain familiar with all ongoing DTF investigations and will be responsible to contact the Chief Law Enforcement officer of a jurisdiction before arrests are made in that jurisdiction. The Control Group will name one of the sub - grant funded investigators as the Operations Coordinator. The Control Group may vote to name any of the other investigators as the Operations Coordinator. PRESS RELEASES. Information concerning administrative activities of the sub -grant shall be given to the news media by the Project• Director. Press Releases concerning arrests, investigations, and other activities at the operation level of the task force shall be given by the Chief law enforcement officer of the particular jurisdiction where the activity takes place. Press releases shall give credit to all participating agencies and the Fourth Judicial District Drug Task Force. All press releases should be reviewed carefully before release to ensure pre-trial publicity and fair trial issues are met. CONFIDENTIALITY. All business, communications, and investigations of the Task Force are considered to be confidential and said information shall not be disclosed to any unauthorized outside party. TERMINATION/MODIFICATION OF AGREEMENT. This agreement may be terminated by any of the parties by notice in writing given to other parties thirty days prior thereto. Deletions, additions, or modifications must be approved by the Board.
