LANDFILL AND APPROVAL OF A BUDGET ADJUSTMENT. 4 F J j {• • BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: • Section 1. That the Mayor land City Clerk are hereby authorized and directed to execute the Memorandum of Understanding between the City and the Arkansas Department of Pollution Control and Ecology in the amount of $15,000.00 as its share of cost in the closure of the landfill. A copy of the agreement authorized for execution hereby is attached hereto marked Exhibit "A" and made a part hereof. Section 2. That the Board of directors hereby approves a budget adjustment in the amount of $15,000.00 for the City's cost in the cleanup of the landfill. The City of Fayetteville ("City") shall provide $15,000.00 to • the Arkansas Department of Pollution Control and Ecology ("ADPC&E") to be used by ADPC&E for taking steps toward proper closure of the landfill owned and formerly operated by Northwest Arkansas Waste Management, Inc., near Springdale, Arkansas. 2. ADPC&E shall have full control over how the money will be spent in closing the landfill, and the City shall not be held liable for any of ADPC&E's actions or omissions in conducting the closure. 3. The providing of these funds by the City shall not further relieve it of any existing liability for closure of the landfill pursuant to the Emergency Response Fund Act, A.C.A. §8-7-401 et seq., or other state or federal law, except to the extent of the • 414 r • • amount of the payment.
