AND APPROVAL OF A BUDGET OF ADJUSTMENT. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the Mayor and City Clerk are hereby authorized and directed to execute a contract for drainage improvements to the Huntingdon area to McClinton -Anchor, A Division of APAC-Arkansas, Inc. in the amount of $86,210.01, with a $12,000.00 contingency for utility relocations. A copy of the contract authorized for execution hereby is attached hereto marked Exhibit "A" and made a part hereof. Section 2. That the Board of Directors hereby approves the budget adjustment in the amount of $14,500.00 to cover the $2,500.00 over budget and $12,500.00 contingent utility relocation. M -Reicher Ov✓rsic n p9./3D/ 1367 Fayt/fev/llo,7z7n- Party of the Second Part: WITNESSETH: That for and in consideration of the payments to be made as hereinafter set forth, the Party of the Second Part hereby agrees to furnish all tools, labor, equipment, materials, and supplies required to be furnished and to construct the improvements designated as Drainage Improvements, Huntingdon Subdivision for the City of Fayetteville, Arkansas, in exact accordance with the Plans on file at the Office of the City Engineer, and Specifications, Proposals, Stipulations, and Special Provisions attached hereto and made a part hereof as fully as though copied herein, under the direction and to the entire satisfaction of the Party of the First Part and in accordance with the laws of the State of Arkansas. 2. It is further agreed and understood by and between the parties hereunto that the Party of the First Part agrees to pay and the Party of the Second Part agrees to accept as full and final compensation for all work done under this agreement, the Unit Prices and/or Lump Sum Price named in the Proposal which is hereto attached, such payment to be made in lawful money of the United States, at the time and in the manner set forth in the Specifications. 3. The Party of the Second Part agrees, for the consideration above expressed, to begin and complete the work within the time specified in the Proposal. Time is expressly made of the essence of this Contract. If the Party of the Second Part shall fail to complete the work in the time specified he shall pay to the Party of the First Part, as liquidated damages, ascertained and agreed, and not in the nature of a penalty, the amount specified in the Proposal for each day delayed, for each Schedule delayed, which shall be deducted from the final amount to be paid under the Contract. Extensions of time may be granted with waiver of liquidated damages as provided for in the Specifications. 4. The Party of the Second Part agrees to furnish a Bond, with an approved Surety thereon, guaranteeing the performance of this Contract, as required by the laws of the State of Arkansas, and for not less than one hundred (100) percent of the amount of this Contract. Said Bond shall be conditioned on full and complete performance of this Contract and acceptance by the City of Fayetteville for the payment of all labor and materials entering into or incident to the proposed improvements and shall guarantee the work against faulty workmanship or materials for a period of one (1) year after completion. The Surety on said Bond shall be a Surety Company of financial resources satisfactory to the Party of the First Part, and authorized to do business in the State of Arkansas. 5. The Party of the Second Part agrees also to carry Public Liability Insurance, Property Damage Insurance, and Workman's Compensation Insurance in amounts as required by these Specifications. ta•t- .. Chie&vrlla .Abhti ga 72702 Business Address AMENDMENTS TO CONTRACT Drainage Improvements, Huntingdon Subdivision Contractor: McClinton -Anchor Owner: City of Fayetteville, Arkansas Negotiations were held in the office of McClinton -Anchor on October 30, 1990. As a result thereof, the following provisions were made to the original Specifications and Contract Documents, and mutually agreed upon between McClinton -Anchor and City of Fayetteville representatives. The following provisions supersede any conflicting portions of the original Contract Documents, and are made an integral part of this Contract The contract time is changed from 45 calendar days to 45 working days. Any required utility adjustments and/ or repairs will be on a cost plus basis. McClinton -Anchor will perform, or have performed, any such utility work and will subsequently submit documentation to the City showing proof of the actual costs involved. The City will then reimburse McClinton -Anchor for the actual costs plus 10%, not 4v e aee.4 lilt io06v A smaller grain size, crushed limestone will be used for pipe bedding material in lieu of that specified originally. This material is as inspected and approved at the negotiation meeting by ETC Engineers, Inc. In consideration of the provisions above, the following changes are made in the Unit Prices of the original Proposal: Item No. 1: $33.43 per lin. ft. Item No. 2: $30.31 per lin. ft. Item No. 3: $33.53 per lin. ft. Item No. 4: $42.49 per lin. ft. Item No. 5: $45.46 per lin. ft. Item No. 15: $7.90 per cub. yd. Amendments to Contract, Page 2 of 2 The resulting total bid price, including the two deductive alternates of the original schedule, is $92,351.59. The City will eliminate the upper portion of Line BA as designated in the Construction Plans. This converts to approximately 118 lin. ft. of Item No. 2, 1 each of Item No. 6 and 52 sq. yd. of Item No. 16. The reduction in the total bid for the eliminated work is $6141.58, making the new total $86,210.01. These revisions are hereby acknowledged and mutually agreed upon by both parties to the Contract. The contract was based on unit prices for materials and specified quantities. This Change lOrder will cover the slight variation on quantities that were incurred, with a decrease of $1,227.06 and an increase of $5,152190, for a total increase of $3,924.85. This Change Order does not affect the total price of the project, which was approved by the Board at $98,210. This Change Order will close out the contract at $92,964.
