RESOLUTION NO. 10-93
A RESOLUTION AUTHORIZING A CERTIFICATE OF
PUBLIC CONVENIENCE AND NECESSITY BE ISSUED TO
B. J. KUEHNEN D/B/A SHUTTLE EXPRESS FOR
OPERATING A TRANSPORTATION SERVICE WITHIN THE
CITY OF FAYETTEVILLE AND SETTING A MAXIMUM
RATE FOR ALL TAXIS OPERATING IN FAYETTEVILLE.
WHEREFORE, the City Council, acting as the Fayetteville Public
Transit Board, has determined that further taxicab service in the
city is required by the public convenience and necessity; and,
WHEREFORE, the applicant, B. J. Kuehnen d/b/a Shuttle Express
is fit, willing, and able to perform such public transportation and
to conform to the provisions contained in the Fayetteville Code of
Ordinances.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1. That City Clerk is authorized to issue a
certificate of public convenience and necessity to B. J. Kuehnen
d/b/a Shuttle Express for operating a transportation service within
the City of Fayetteville. A copy of which is attached hereto
marked Exhibit "A" and made a part hereof.
Section 2. That the rates charged for all taxi companies
operating in the City of Fayetteville shall be no higher than the
highest rate approved by the City Council in an active certificate
of public convenience and necessity.

CERTIFICATE OF PUBLIC CONVENIENCE
AND NECESSITY
This Certificate of Public Convenience and Necessity has been
issued to:
B.J. Kuehnen. dba SHUTTLE EXPRESS
as approved by the Fayetteville City Council on the 5th day of
January, 1993.
This Certificate allows the taxi (transportation) service to
operate within the city limits of Fayetteville as per the proposal
for operation submitted to and approved by the City Council.

APPLICATION FOR CERTIFICATE
OF PUBLIC CONVENIENCE AND NECESSITY
In accordance with §117.32 of the Code of Ordinances of
the City of Fayetteville, Arkansas, the following information
is respectfully submitted:
1. The name and address of the applicant is B.J. Kuehnen,
115 East 26th Circle, Fayetteville, Arkansas 72701, and the
person to whom complaints should be directed.
2. The applicant is in good financial standing with no
judgments against her.
3. The applicant has had no prior experience in operating
a vehicle -related business.
4. The applicant desires to operate a taxicab service to
provide transportation to citizens of Fayetteville to and from
the Fayetteville Municipal Airport, Tulsa International Airport,
with further possible service to Fort Smith, Little Rock, Hot
Springs, West Memphis, and Branson, Missouri. At the present
time, there is no ground transportation available to the
aforementioned cities for individuals or groups not large enough
to charter a bus. The initial emphasis of the business will
be to target travelers desiring to fly out of the Tulsa airport
by providing two departures per day.

5. The applicant plans to begin operations with one (1)
1993 Ford Aerostar XL Plus Van, capable of
(7) passengers and will pick up passengers
transporting seven
at their homes.
The applicant is currently negotiating with Northwest Arkansas
Mall to establish a depot or terminal at that location.
6. The applicant intends to purchase
the van described
above from Lewis Ford upon approval by the Public Transit
Board of this application. The van applicant will purchase
if approved is red and the insignia of the business will be
white letters "SHUTTLE EXPRESS" painted on the side of the van.
7. The applicant proposes two scheduled departures
daily to Tulsa International Airport, seven (7) days a week.
8. A rate schedule along with a letter of commitment
to issue the required insurance coverage is attached hereto.
