k RESOLUTION AUTHORIZING A CONTRACT WITH J.D.
SWEETSER, INC. FOR GROUP "C" WATER LINE
REPLACEMENTS.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
F AYETTEV I T.LE , ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby
authorized and directed to execute a contract between the City and
J.D. Sweetser, Inc. in the amount $192.582.00 for Group "C" water
line replacements. A copy of the contract authorized for
execution hereby is attached hereto marked Exhibit "A" and made a
part hereof.

Award of Construction Contract
Date: June 4, 1990
The above project is a budgeted project which has been approved by
the Board.
The vicinity map attached shows the location of these water lines
which are located along Hwy 62 West and Old Farmington Rd.
These water lines are scheduled for replacement because of
maintenance problems.
On 5/18/90 bids were received for this project and a copy of the
bid tabulation sheet is attached for your information.
The low bidder is J. D. Sweetser, Inc. for the base bid, PVC pipe,
in the amount of $196,227.00.
It is the recommendation of the Engineer that approximately 180
feet of the 12" water line replacement be deleted from this
contract, because further information provided by the maintenance
division has assured the integrity of the existing pipe. This
portion is marked on the vicinity map. The amount of the scaled
down contract will be $192,582.00.
The PVC pipe is chosen for this project because the soil is very
corrosive.
The Staff recommends that the contract be awarded to the low bidder
J. D. Sweetser, Inc. in the amount of $192,582.00.

AGREEMENT
THIS AGREEMENT, made this day of , 19 , by and
between City of Fayetteville , hereinafter called "OWNER" and
(name of Owner), (an Individual)
Jerry D. Sweetser, Inc. doing business as (an individual,) or
(a partnership,) or (a corporation) hereinafter called "CONTRACTOR".
WITNESSETH: That for and in consideration of the payments and agreements
hereinafter mentioned:
1. The CONTRACTOR will commence and complete the construction of Group
"C" Water Line Renlacements(Hwy. 62 W, and Old Farmington Road).
2. The CONTRACTOR will furnish all of the materials, supplies, tools,
equipment, labor, and other services necessary for the construction
and completion of the PROJECT described herein.
3. The CONTRACTOR will commence the work required by the CONTRACT
DOCUMENTS within 20 calendar days after the date of the NOTICE
TO PROCEED and will complete the same within 120 calendar days
unless the period for completion is extended otherwise by the CONTRACT
DOCUMENTS.
4. The CONTRACTOR agrees to perform all of the WORK described in the
CONTRACT DOCUMENTS and comply with the terms therein for the sum of
$ 192,582.00 or as shown in the BID schedule. amount to be

6. The OWNER will pay to the CONTRACTOR in the manner and at such times
