A RESOLUTION. AUTHORIZING THE PURCHASE, OR
ACQUISITION BY EMINENT DOMAIN ACTION, OF 3.19
ACRES OF LAND WEST OF THE WALTON ARTS CENTER
FOR PARKING LOT CONSTRUCTION AND APPROVAL OF A
BUDGET ADJUSTMENT.
WHEREAS, at the regular Board meeting of September 5, 1989,
the Board of Directors approved a contract for construction in
connection with the parking lot west of the Walton Arts Center
and;
WHEREAS, it is necessary for the City to acquire 3.19 acres
of land in an area between Dickson and Spring Streets, west of
West Street and east of Gregg Avenue in order to begin such
construction and;
WHEREAS, the City can attempt to negotiate the sale of said
land at a price up to 10% above their appraised value and;
WHEREAS, the City may seek to acquire said land for public
purposes through eminent domain proceedings should negotiations
for purchase fail and;
WHEREAS, a budget adjustment will be needed in the amount of
$53,000.00 will be needed if a negotiated price for the land is
paid by the City;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby
authorized to seek to acquire. by a negotiated price not to exceed
10%' above appraisal value, those four parcels of property of
approximately 3.19 acres located in an area between Dickson and
Spring Streets, west of West Street and east of Gregory Avenue as
more fully set forth in the attachments hereto.
Section 2. That in the event such negotiations as to
price of said property is unsuccessful, the City Attorney of the
City of Fayetteville is authorized to seek to obtain the property
or portions of said property by eminent domain or other
appropriate legal means as he deems necessary.
Section 3. A budget adjustment of $53,000.00 is
authorized as more fully set forth on Adjustment No. 413,
attached, in order to supply sufficient funds to the Land
Acquisition Account for the negotiated purchase of said property.
