RESOLUTION NO. 60-89
A RESOLUTION AUTHORIZING CONSTRUCTION OF A
CHAIN-LINK FENCE IN EXCHANGE FOR A RIGHT
OF WAY EASEMENT.

BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby authorized and
directed to execute a contract with Fayetteville Baptist Church, also known as
Winwood Baptist Church, wherein the Church will grant to the City a perpetual
easement over and upon the property described in Exhibit "A", which is attached,
in exchange for construction of a chain-link fence on the property line between
Gulley Park and Winwood Baptist Church as described in a letter dated April 11,
1989 from the Rev. Randall Garrison.

EASEMENT DESCRIPTION
A part of the SE* of the SWI of Section 36, T -17-N, R -30-W, the
point of beginning described as follows:
Commencing at the Southwest Corner of said 40 -acre tract
and running thence North 35.00 feet to the North right-
of-way of Township Road, continuing thence along said
right-of-way N 88-39-21 E 231.01 feet to the point of
beginning; said point being a set iron pin on the North
right-of-way of said road; Thence leaving said right-of-
way N 50-16-23 E 244.94 to a set iron pin; Thence S 88-
_51-27 E 222.06 feet to a set iron pin; THence S 46-42-37
W 159.99 feet to a set iron pin;' Thence S 13-39-21 W
436.76,feet to a'set iron pin on the said North right-of-
way; Thence along said right-of-way S 88-39-21 W 285.34
feet to the point of beginning, containing .084 acres,
more or less, City of Fayetteville, Washington County,
Arkansas. Subject to: a 25 foot utility easement
located across the western portion of above described
tract as recorded in Book .754, Page 476, Washington
County, Arkansas.

That the undersigned grantors Fayetteville Baptist Church a/k/a Winwood
Baptist Church for the consideration of One Dollar ($1.00) and other good
and valuable consideration, to them in hand paid .by the City of
Fayetteville, Arkansas, a municipal corporation, the grantee, the receipt of
which is hereby acknowledged, does hereby grant, bargain, sell and convey to
the City of Fayetteville, Arkansas, a municipal corporation, a perpetual
easement for the purpose of constructing, maintaining, repairing and
replacing a public street, utility lines, sidewalks, public drainage, to -
wit:

PROPERTY DESCRIPITON:
Part of the Southwest Quarter (SW1/4) of the Southeast Quarter (SE1/4) and
. part of the Southeast Quarter (SEI/4) of the Southwest Quarter (SW1/4) of
Section Thirty-six (36) in Township Seventeen (17) North of Range Thirty
(30) West, described as follows, to -wit: Beginning at the Southwest corner
of said last mentioned forty acre tract, and running thence East 90 rods
thence North 205 1/3 feet, thence West 90 rods, thence South 205 1/3 feet to
the point of beginning, containing seven (7) acres, more or less.
