A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A MODIFICATION OF LEASE
AGREEMENT WITH LORENE O'DONNELL, FOR LEASE OF
SPACE AND OPERATION OF THE AIRPORT RESTAURANT
IN THE AIRPORT TERMINAL BUILDING.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby
authorized and directed to execute a modified lease agreement with
Lorene O'Donnell for the leasing of 'space and operation of the
Airport Restaurant. A copy of the modified lease agreement
authorized for execution is attached hereto marked Exhibit "A" and
made a part hereof.

SUBJECT: Lease Modification
Attached please find the negotiated rates which were sent and
approved by the Fayetteville Board of Directors on April 18, 1989.
The rate'increase was approved on a retroactive basis, effective
December 15, 1988.
Should you need any assistance in determining the retroactive fees
due the City please contact this office and Staff will assist you
in these computations.

Attached please find an agenda reauest form for the above
referenced lease modification. As required by the lease the
compensation rate is to be negotiated annually.
The rates which this staff has negotiated with the Airport
Restaurant reflect almost all the recommendations made by the
consultant in his preliminary report, (we have just received the
final report for review).
Below please find listed his suggested rates for the operation.
A minimum guarantee for base rent was established by adjusting the
previous rental rate by the change in the consumer price index for
1988.
1988 COMPENSATION RATE: $1,498.75 per month or 8% of gross, which
ever is greater.
CONSULTANTS RECOMMENDED RATE 1989
8% on food sales
8% on beverage sales
12% on Beer and Light Wines
15% on Magazines and Gifts
15% on miscellaneous items
50% on electronic games
RATES NEGOTIATED BY STAFF
8% on food sales
8% on beverage sales
12% on Beer and Light Wines
13% on Magazines
15% on Gifts
15% on miscellaneous items
50% on electronic games
The percentages will be paid on the same monthly basis that
currently, exists. If the percentage payment is lower than the
minimum guarantee, the minimum guarantee of $1,564.70 will be the
required payment.
The City Attorney will need to prepare the lease modification.
The negotiated percentages will be retroactive to the annual date
renewal date of 12-15-88.
