RESOLUTION NO. 20-89
A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A SUBGRANT AGREEMENT WITH THE
ECONOMIC OPPORTUNITY AGENCY OF WASHINGTON
COUNTY, ARKANSAS TO FUND THE "YOU CAN!"
PROGRAM.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby
-.authorized and directed to "execute a subgrant agreement with the
Economic Opportunity, -Agency of Washington County, Arkansas to
provide funding for the "You Can!" Program. A copy of the
subgrant agreement authorized for execution hereby is attached
hereto;marked Exhibit."A""and'made a part hereof.

Sub -Grant Agreement

This Agreement entered into this 15th day of March. 1989 by and
between the Economic Opportunity Agency of Washington County. Arkansas, hereinafter
called Subgrantee, and the City of Fayetteville, Arkansas hereinafter called Grantor,
WITNESSETH:
Whereas. the subgrantee operates as an anti -poverty community action agency
in Washington County. Arkansas where Fayetteville is located and has many requests
for educational, job training. and child care assistance from residents within the
city limits of Fayetteville: and,
Whereas. the Grantor acknowledges the benefits of a program assisting residents
to further their education, participate in job training, and open their own home
based childcare facilities.
Now Therefore. in consideration of the benefits to be derived by the citizens
of Fayetteville from Subgrantee's You Can! program. Grantor agrees to furnish Subgrantee
a maximum of $57.950 for the purpose of underwriting the You Can! program for
a period of twelve months in the corporate limits of the Grantor. Continued funding
for a maximum of 48 months (a total of 5 years] shall be at the sole discretion of
Granter's Board of Directors. Said grant shall be subject to the following conditions:
1. Conditions of Grant
All funds made available by Grantor to Subgrantee shall be used only in Subgrantee's
You Can! program. The grant amount shall underwrite administrative costs of $22,450
plus thirty-five $500 stipends and nine $2,000 family day care home improvement
loans. All loan repayments will be forwarded to the City of Fayetteville.
2. Method of Payment
Payment of grant funds to Subgrantee for administrative purposes shall be
on a monthly basis, with the exception of a two month start up disbursement of
$3,740, or 2/12 of the total administrative amount budgeted. to be available on March
15, 1989. Monthly administrative amounts of $1,870 will thereafter be available
on the fifteenth day of each month through January 15, 1990.
Payment of grant funds for education/job training stipends and child care loans
shall be made twice: 50% or $17,750 to be available on March 15. 1989 and an equal
amount to be available on August 15, 1989.
3. Time of Performance
The term of this contract shall be twelve [12) months commencing March 15,
1, 1989 and ending March 14. 1990.
4. General Provisions
A. Subgrantee agrees to hire a licensed professional social worker
to direct the You Can! program by 3/15/89. This person will be directly supervised
by the Executive Director of the Subgrantee.
B. Subgrantee agrees to assist a minimum of 35 impoverished Fayetteville
residents at or below 125% of the current federal poverty threshold to enroll in
either vocationally oriented courses of study at post -secondary institutions of higher
learning or in on-the-job training positions funded through the Job Training Partnership
Act Program. Five hundred dollar [`5500] stipends plus counseling and follow-up
will be available to each participant.
C. Subgrantee agrees to assist a minimum of nine (9) low to moderate
income Fayetteville residents at or below 150% of the current Federal poverty threshold
to own and operate licensed family child care facilities in their homes. Two thousand
dollar [2,000) no interest loans will be extended to participants or, in cases where
participants are tenants. to landlords who agree to forego rent increases for a period
of three years. A legal agreement shall be signed between subgrantee and each
loan recipient detailing a repayment schedule.
D. Subgrantee agrees to establish the following objectives in program
administration:
-Achieve a minimum of 70% placement and retention rate among
participants who enroll in program as part or full-time students
during the 12 month period or segment thereof in which matriculation
in school is accomplished.
-Achieve a minimum of 70% placement retention and completion
rate among participants who enroll in program as on-the-job trainees.
Furthermore. 70% of on the -job trainees will obtain and retain
unsubsidized employment or continue their education after completion
of their on-the-job training.
-Achieve a minimum of 67% success rate among participants who
accept loans and training to open licensed family day care facilities.
Such facilities will continue in operation for the 12 month period
during which the loan is extended.
E. Subgrantee agrees to limit to a maximum of 11% (4) the number
of $500 education/job training stipends awarded to program participants already
enrolled in educational courses or on-the-job training. Eighty-nine percent (B9%]
(31) program participants will be new students or job trainees.
F. Subgrantee agrees to perform all follow-up necessary to evaluate
success of program.. A month? report on program operation will be submitted to
Ms. Jan Simco. City of' Fayetteville Community Development Director. on the 10th
day following the end of each month.
G. Subgrantee agrees to establish an Advisory Committee made
up of a representative of professional human service providers. educators. and the
City of Fayetteville. The Advisory Committee will consist of a minimum of eight
members, two of whom will be chosen by the Board of' Directors of the City of Fayetteville.
The Program Director will provide copies of monthly reports to the Advisory Committee
and will convene the Committee on a quarterly basis to review and evaluate program
progress. With the assistance of the Program Director. the Advisory Committee
will submit minutes of its quarterly meetings to Jan Simco. City of Fayetteville
Community Development Director. an the 10th day following each quarterly meeting.
H. Subgrantee will establish safeguards to prohibit employees
from using positions for a purpose that is, or gives the appearance of being, motivated
by a desire for private gain for themselves or others, particularly those with whom
they have family. business. or other ties.
I. Subgrantee will comply with the provisions of the Hatch Act
which limits the political activity of employees.
J. Subgrantee will give the Fayetteville City Manager and Comptroller
through any authorized representatives access to and the right to examine all records,
books. papers, or documents related to the grant. -
5. By executing this Agreement. Grantor does not waive its statutory tort
immunity under Arkansas Code Ann. Section 21-9-301 (1967).
