A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO APPROVE AN AMENDMENT TO A BILL OF
ASSURANCE FOR PROPERTY LOCATED AT 215 NORTH
EAST STREET TO AUTHORIZE THE OPERATION OF A
TEA ROOM OR RESTAURANT.

BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF

FAYETTEVILLE, ARKANSAS: -
Section 1.* That the Mayor, and City Clerk. are hereby
authorized and directedto execute an amendment to a Bill of
Assurance for property located at 215 North East Street to
authorize operation of a tea room or restaurant.

This declaration of a Bill of Assurance made this / I/1h day of ,77,2124c4
1989 by the undersigned, Dan and Deborah Coody, owners of real property located
at 215 N. East Avenue, Fayetteville, Arkansas. This Dill of Assurance supercedes
the Bill of Assurance filed at Book 1233, Page 584 filed on July 15, 1987.
WHEREAS, the aforesaid Owners of said property have purchased the building
located at 215 N. East Avenue for the purpose of operation by Owners of antique/
Sb art gallery/offices/residence/tea room or restaurant, and
JWIIL'.REAS, the Ownors are desirous of making a declaration of the same in the
form of this Bill of Assurance with the intention of guaranteeing the preservation
of certain values and amenitities in the community and to bind the Owners and
their respective successors and assignes in the real estate above described with
the obligations and restrictions hereinafter set forth for present and future
development and use of said property.
NOW, THEREFORE, the Owners declare that the above described real property
shall be held, developed, transferred, sold, conveyed, and occupied subject to
the covenants and restrictions herein set forth:
1. That the building at 215 N. East Avenue, Fayetteville, Arkansas be
used only for antiques/art gallery/offices/resident tea room ort
Cestaurant.
2. This Bill of Assurance shall be binding upon Owners and their
successors and assigns, /1"
