BE IT RESOLVED BY THE BOARD` OF{. DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the Board of Directors authorizes payment of $85,349.94 to McDermott, Will & Emery Law Firm for legal services rendered from June -October 1989. A copy of the statement authorized for execution hereby is attached hereto marked Exhibit "A" and made a part hereof. Section 2. The Board of Directors authorizes payment of $18,440.52 to the Niblock Law Firm for legal services rendered for October 5 -November 3, 1989. A copy of the statement authorized for execution hereby is attached hereto narked Exhibit "B" and made a part hereof. PASSED AND APPROVED this 19th day of December , 1989. A resolution authorizing approval for the payment of $85,349.94 to the McDermott, Will & Emery Law Firm for June -October, 1989 and $18,440.52 to the Niblock Law Firm for October 5 -November 3, 1989, for services rendered on the incinerator project; 26-63 REZONING: An ordinance rezoning property as Rezoning Petition R89-32. Size of Parcel: Location: North Salem Road 16.84 acres requested in of Hwy 16 West on the east and west sides of Petitioner: Bob Davis Change Requested: From R-2 "Medium Density Residential" to C-2 "Thoroughfare Commercial" Planning Commission Action: Recommended approval by 5-3-0 ote to rezone the eastern section of the property (to the east side of the road dividing it) and leave the western portion as it is presently zoned. The initial motion was to approve the rezoning. However, the vote was tied at 4-4-0 with Ozment, Seiff, Hanna, and Allred voting for and Springborn, Jacks, Cleghorn, and Klingaman voting against the motion. It takes 5 positive votes to approve a rezoning petition, so the motion failed. 4 PROPERTY CLEANUP: An ordinance ordering the abatement of unsightly conditions and the razing and removal of unsafe structures located at 1723-1725 West Mitchell. The Staff recommends approval of this ordinance. The ordinance was left on its 1st reading at the November 7 Board meeting. The condemnation is requested for the vacant, dilapidated, and unsafe building owned by Myrtle Winkle and Madeline Tribble. Linebaugh, Assistant City Manage,4°Q( DATE: December 7, 1989 SUBJECT: Request for Payment of Attorney's Fees Concerning Incinerator Disengagement Attached to this memorandum, you will find three (3) statements for services rendered by attorneys concerning the incinerator disengagement. The first statement is for the Niblock Law Firm for legal services performed from October 1, 1989 through November 16, 1989. It totals $18,440.52. The second statement is from McDermott, Will and Emery for legal services performed from June through July 31, 1989. It totals $26,668.53. The third statement is also from McDermott, Will and Emery for legal services performed from July 1, through October 31, 1989. It totals $58,661.41. (Although there is an overlap of the dates shown on the two statements from McDermott, Will and Emery I can find no duplication of charges. I confirmed this with Mr. Tom Ingoldsby.) I have also requested from McDermott, Will and Emery monthly billings from this point onward. - These statements represent the second set of billings relative to the City's defense in its current lawsuit with Mr. Robson. As you are aware, the estimated figure given to the Board was $500,000 for attorney's fees to defend the City in this lawsuit if we are successful on the first level. We have previously paid the Niblock Law Firm $33,657.66 for defending the City.
