RESOLUTION NO. 97-87
A PESSOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE AN EMPLOYMENT AGREEMENT WITH
ROBERT W. FRANZMEIER FOR COORDINATION OF THE
CITY'S WASTEWATER TREATMENT PLANT CONSTRUCTION
PROJECT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute an employment agreement with Robert W.
Franzmeier for coordination of the City's wastewater treatment
plant construction project. A copy of the agreement authorized
for execution hereby is attached hereto marked Exhibit "A" and
made a part hereof.

EMPLOYMENT AGREEMENT

This Employment Agreement executed this 5th day of November,
1986, between the City of Fayetteville, Arkansas, hereinafter
called the Employer, and Robert W. Franzmeier, hereinafter called
the Employee.
IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN,
the Employer and the Employee hereby agree as follows:
1. The Employer hereby employs the Employee as Project
Coordinator for the construction of improvements to the City's
wastewater treatment plant and system in accordance with plans
and specifications prepared by CH2M Hill and McClelland Consulting
Engineers, Inc. for EPA Project Nos. C-050366-11-2, C-050366-12-1
and C-050366-13-2.
1A. Should the above -listed projects be completed before
this Agreement expires, the Employee may be required to provide
the same service for the expected waste disposal project.
2. The Employee shall perform the following duties:
(a) Monitor the progress of the project and advise the
Employer of any problems which may arise with the
project;
(b) Attend all meetings between the project engineer
and the project contractor;
(c) Review daily reports of inspections for quality
control from the project engineer;
(d) Review and process all pay requests from the project
contractor,
(e) Review any contract changes or change orders requested
by the engineer or the contractors, and recommend
to the Employer whether said contract changes or
change orders should be approved;
(f)
Prepare a project library consisting of as -built

plans and specifications, shop drawings,
correspondence, change orders, requests for payments,
payments made, inspection diaries, memoranda,
directories, and miscellaneous field notes;
(g) Provide the Employer with periodic reports, including
photographs, on the progress of construction;
(h) Serve as a liaison between the contractor and property
owners during construction to insure that any
complaints are properly resolved;
(i) Assist in the final inspection of each phase ofthe
project;
(j) Review all claims arising during the course of
construction;
(k) Coordinate the purchase and delivery of
Employer -purchased equipment;
(1) Coordinate implementation of the City's grant
agreement under the Clean Water Act with the United
States Environmental Protection Agency and the
Arkansas Department of Pollution Control and Ecology;
and
(m) Perform such other duties related to the project
as may be assigned by the Employer.
3. The Employee's hours of work shall be Monday through
Friday or as modified by Employer's City Engineer.
4. The term of this Employment Agreement shall be for a
period of one year commencing on November 5, 1986, and terminated
on November 4, 1987; provided, should the project not be completed
on November 4, 1987, the Employee agrees that this Agreement
shall be extended until the project is completed; provide further,
the Employer or the Employee may terminate this Contract at any
time upon sixty (60) days written notice.
5. The Employer shall pay the Employee a salary of two
thousand eight hundred fifty dollars ($2,850.00) per month for
the life of the Agreement. The Employee shall be paid on a
bi-weekly basis.

4. The tens of this employment agreement shall be for a period
of two years ccniencing on November 5, 1984, and terminating on November
4, 1986; provided, should the project not be completed on November
4, 1986, the Employee agrees that this agreement shall be extended
until the project is completed; provided further, the Employer or
the Employee may terminate this contract at any tine upon sixty (60)
days written notice.
5. During the first six months of this agreement, the Employer
shall pay the Employee a salary of two thousand five hundred dollars
($2,500.00) per month. Thereafter, the Employee shall be paid two
thousand six hundred twenty-five dollars ($2,625.00) per month. The
Employee shall be paid on a bi-weekly basis.
6. The normal rules and regulations governing employment by
City of Fayetteville shall apply unless specified differently in this.
contract.
