HomeMy WebLinkAbout81-87 RESOLUTION• RESOLUTION NO. 81-87 A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO INITIATE EMINENT DOMAIN PROCEEDINGS TO CONDEMN 1.16 ACRES OF LAND LOCATED AT THE NORTHWEST CORNER OF SPRING STREET AND SCHOOL AVENUE FOR THE CITY'S ARTS CENTER PROJECT. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1.-f That the City =Attorney ishereby authorized and directed to institute eminent domain proceedings to condemn the real property described in Exhibit "A" attached hereto and made a part hereof to be used for the City's :Arts Center Project. Davis, husband and wife PROPERTY DESCRIPTION: An undivided one-half (1/2) interest in a part of Block Six (6) in the Original Town (now City) of .Fayetteville, Arkan- sas, as per plat on file in the office of the Circuit Clerk and Ex -Officio Recorder of Washington County, Arkansas, and being more particularly described as follows, to -wit: Beginning at the Southeast corner of Block Six (6) and running thence West 162.5 feet; thence North 311.0 feet; thence East 162.5 feet; thence South 311.0 feet to the point of beginning, containing 1.16 acres, more or less. The undivided one-half interest being conveyed to James D. Davis and Yenny L. Davis, husband and wife, as tenants by the entirety, herein, is subject to a first mortgage in favor of John B. Baggett and Jeff Baggett, dated March 6, 1980, in the original principal amount of $95,850.00, said mortgage currently securing the sum of $69,152.06 (principal and interest) as of 1/1/82. Grantees herein jointly and sever- ally assume and agree to pay one-half (1/2) of the aforesaid balance due in accordance with the terms and conditions set forth in said mortgage and the note secured thereby. Subject to all roadways, easements and restriction of record, if any. EXHIBIT A
