A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE CHANGE ORDER NO. 21 TO THE
CITY'S CONTRACT WITH OLSON CONSTRUCTION
COMPANY FOR A NEW WASTEWATER TREATMENT PLANT
TO DECREASE THE QUANTITY OF SLURRY TRENCH
WALL.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF. THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute Change Order No. 21 to the City's contract
with Olson Construction Company for a new wastewater treatment
plant to decrease the quantity of slurry trench wall. A copy of
the change order authorized for execution hereby is attached
hereto marked Exhibit "A" and made a part hereof.

Contractor: Olson Construction Company
The following modifications to the contract are hereby ordered:
Decrease the quantity of slurry trench wall provided for the
effluent storage reservoir determined as calculated by Olson
Construction Company in their letter dated January 29, 1986. The
quantity of trench wall that the bid was based on amounts to
110,000 vertical square feet (vsf) of slurry wall. The final
installed slurry wall was 100,973 vsf. ($24,824)
Round contract amount to begin the completion contract ($0.44)
Extend contract time per Agreement with City, USF&G and Huber,
Hunt, Nichols, Inc.
This contract modification constitutes full and mutual accord and
satisfaction for all time and all costs related to this change.
By acceptance of this contract modification, the contractor hereby
agrees that the modification represents an equitable adjustment to
the contract, and further, agrees to waive all right to file any
further claims or changes arising out of or as a result of this
change, or the accumulation of executed Contract Modifications on
this Contract.
