A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE CHANGE ORDERS IN THE CITY'S CONTRACT
WITH OLSON CONSTRUCTION COMPANY FOR IMPROVEMENTS
TO THE WASTEWATER TREATMENT PLANT TO PROVIDE FOR
ADDITIONAL PUMP FLANGES AND FOR MODIFICATION OF
A SUPPORT CHANNEL AT THE RECYCLE PUMP STATION.
BE IT RESOLVED BY THE BOARD OF DIRECTCIRS OF IRE CITY OF FAYETTE'VILLEF
ARKANSAS:
That the Mayor and City Clerk are hereby authorized and directed
to execute change orders to the City's contract with Olson Construction
Company for improvements to the Wastewater Treatment Plant to provide
for additional pump flanges and for modification of a support channel
at the recycle pump station. Copies of the change orders authorized
for execution hereto are Attached hereto marked Exhibits "A" and "B"
and made a part hereof.

The following modifications to the contract are hereby ordered: (Use additional pages if
required.)
Provide a special flange to join each of the 6-16" Denitrification Pump discharge flanges
with the 6-18" pipe flanges per CR 0416. Order and receive the materials using force
account methods as covered by the General Conditions, Article 70. An estimate of $6,730
is established for this force account, Phase I, change. The estimated price will be
changed to actual cost in a subsequent Contract Modification.
The parties cannot agree on the amount, if any, of time extension involved with the extra
work, and therefore have agreed to bold consideration of a time extension, if any, and any
costs associated with the same in abeyance. It is agreed by the parties that the contract
provisions shall govern this Contract Modification except for the third sentence of the
second paragraph of Article 70, General Conditions which is hereby modified.

This contract modifications constitutes full and mutual accord and satisfaction for all
time and all costs related to this change. By acceptance of this contract modification,
the contractor hereby agrees that the modification represents an equitable adjustment to
the contract, and further, agrees to waive all right to file any further claims or changes
arising out of or as a result of this change, or the accumulation of executed Contract
Modifications on this Contract.
