RESCTLNION NO. 99-86
A RESOLUTION SUPPORTING AN APPLICATION BY THE
STATE OF ARKANSAS TO ADMINISTER THE NATIONAL POLLUTANT
DISCHARGE ELIMINATION SYSTEM (NPDES) PROGRAM.
WHEREAS, the State of Arkansas has submitted an application to
the United States Environmental Protection Agency to administer and
enforce the National Pollutant Discharge Elimination System (NPDES)
program for regulating discharges of pollutants into .waters within
the State; and
WHEREAS, according to the State's proposal, the NPDES program
would be administered by the Water Division in the Arkansas Department
of Pollution Control and Ecology (ADPC&E); and
WHEREAS, the Environmental Protection Agency has scheduled a
public hearing on September 23, 1986, from 7:00 p.m. to 10:00 p.m. to
consider the aforesaid application and has requested public comments
on said application; and
WHEREAS, under Section 402 of the Clean Water Act, ADPC&E may
assume NPDES program responsibility upon a determination by EPA that
the State agency has the capability of running the full equivalent
of the federal program and has full legal authority to impose civil
and criminal penalties for permit violations; and
WHEREAS, ADPC&E has said capability and legal authority; and
WHEREAS, ADPC&E can administer the NPDES program more effectively
and efficiently than EPA because the State agency is more familiar
with all aspects of water pollution problems in Arkansas.
Nei, Tom, BE IT RESOLVED BY TEE BOARD OF DIRECIDRS OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
That the Board of Directors hereby strongly supports the application
submitted by the State of Arkansas to the Environmental Protection
Agency to administer and enforce the National Pollutant Discharge
Elimination System (NPDES) program through the Water Division in the
Arkansas Department of Pollution Control and Ecology.
