RESOIOlfION NO. 96-86
A RESOLUTION EXPRESSING THE INTENT OF THE FAYETTEVILLE
BOARD OF DIREC1URS TO REQUIRE NON -PARTICIPATING
PROPERTY OWNERS IN THE WEDINGTON. AREA DRAINAGE
PROJECT TO CONSTRUCT. DRAINAGE IMPROVEMENTS AT
THEIR COST WHEN THE PROPERTY IS DEVELOPED.
WHEREAS, the City of Fayetteville is undertaking the construction
of drainage improvements in the Wedington Drive area; and
WHEREAS, many property owners have dedicated the necessary easements
in consideration for the City constructing the proposed drainage improve-
ments; and
WHEREAS, certain property owners have refused to dedicate the
necessary reasements and are requesting that the City compensate them
for said easements and construct the improvements at no cost to them;
and
WHEREAS, the Board of Directors has determined that said properties
should be excluded from the Wedington Area Drainage Project because
of the substantial amount of moneys required to acquire the necessary
easements.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYEPPEVILLE, ARKANSAS:
That the properties described in Exhibits "A" and "B" attached
hereto and made a part hereof shall be excluded from the Wedington
Area Drainage Project and the property owners shall be ,required to
construct at their cost drainage improvements required by the City's
large scale development and subdivision regulations at such time as
said properties are developed.
