A RESOLUTION AUTHORIZING THE MAYOR AND CITY CrFRK
TO EXECUTE A ONE-YEAR PASTURE LEASE WITH DAVID
B. CLARK FOR APPROXIMATELY 198 ACRES OF LAND NEAR
THE POLLUTION CONTROL PLANT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
That the Mayor and City Clerk are hereby authorized and directed
to execute a one-year pasture lease with David B. Clark. A copy of
the lease authorized for execution hereby is attached hereto marked
Exhibit "A" and made a part hereof.

This LEASE executed this

between the City of Fayetteville, Arkansas, hereinafter called "Lessor",
and David B. Clark, hereinafter called "Lessee".
IN CONSITERPSION OF THE MUTUAL COVENANTS CONTAINED HEREIN, Lessor
and Lessee hereby agree as follows:
1. Lessor hereby leases to Lessee, and Lessee hereby leases
from Lessor, the following described real property located in Washington
County, Arkansas:
The Northeast Quarter (NE 1/4) of the Northwest Quarter
(NW 1/4) of Section 9; the West Half (W 1/2) of the Southeast
Quarter (SE 1/4) of Section 4, IJS AND EXCEPT two (2) acres
lying East of the River in the Northeast Corner of said
80 acre tract, and the East Half (E 1/2) of the Southwest
Quarter (SW 1/4) of Section 4, all in Township 16 North,
Range 29 West, containing 198 acres, more or less.
2. The term of this lease shall be for a period of one year
commencing on the execution date hereof; provided, at the request
of Lessee, Lessor may extend the term of this lease for two (2) additional
years.
3. During the initial term of this lease, Lessee shall pay
Lessor as rent the total sum of Three Thousand Eight Hundred Ten Dollars
($3,810.00) which sum shall be payable as follows: one-half of the
total sum upon execution of this lease and the balance of the total
sum on or before February 1, 1987. Should the term of this lease
be extended, the rent payable by Lessee for each additional year shall
be adjusted to reflect the percentage change in the Consumer Price
Index, All Consumers, United States Department of Labor for the preceding
twelve (12) month period. As adjusted, the rent for any additional
year shall be payable as follows: in a lump sum on the first day
bf the extended term:
4. Lessee shall use the demised premises solely to provide
pasture for Lessee's livestock and to remove hay.
5. Lessee shall maintain all existing fences on the demised
premises in good condition.
6. Lessee shall fertilize the demised premises so that, upon
expiration of this lease or any extended term thereof, the demised
premises shall be in as good condition as on the execution date hereof.
7. Lessee shall not remove, or permit to be removed, any tree,
rock or soil from the demised premises.
8. Lessee shall not hunt, or permit any other person to hunt,
on the demised premises.
9. Lessee shall mow at least one time per year all areas of
the demised premises which Lessee has not otherwise mowed for hay.
10. Lessee shall hold Lessor harmless from any and all damages
caused by the acts of Lessee or Lessee's agents or employees on the
demised premises.

11. Lessor shall have the right to enter the demised premises
at any time for the purpose of inspecting the property, surveying,
or constructing public improvements; and, Lessor shall not be liable
to Lessee for damages as a result of such entry, surveying, or con-
struction.
