MITCHELL AND SHIRLEY ANN KENNON FOR A RESIDENTIAL STRUCTURE LOCATED ON THE CITY'S SLUDGE SITE IN THE WYMAN.COMMUNITY. BE IT RESOLVE BY THE BOARD OF DIRECTORS OF THE CITY OSP' FAYEITAV LLE, ARKANSAS. That the Mayor and City Clerk are hereby authorized and directed to execute a lease agreement with Francis M. Mitchell and Shirley Ann Kennon for a residential -structure located on the City's sludge site in the Wyman Community. A copy of the Lease Agreement authorized for execution hereby is attached hereto marked Exhibit "A" and made a part hereof. PASSED AND APPROVED this 4 day of APPROVED NnvPmhar , 1986. • F$ LEASE AGREEMENT This LEASE AGREEMENT executed this / - day of (Tc 1986 by the City of Fayetteville, Arkansas, hereinafter called "Lessor", with Frances M. Mitchell and Shirley Ann Kennon, hereinafter called "Lessees". IN CaSIDCRATICN OF THE MVIUAL, amazon's CONTAINED IIEREIN, Lessor and lessees hereby agree as follows: 1. Lessor hereby leases to Lessees, and Lessees hereby lease from Lessor, the residential structure located on the real property described in Exhibit "A" attached hereto and made a part hereof. 2. The teen of this agreement shall commence on the execution date hereof and shall expire on June 30, 1987; provided, Lessor may terminate this agreement at any time by giving Lessees thirty (30) days written notice of termination. 3. Lessees shall provide .proper. maintenance and security for the demised premises at all tines during the term of this lease. Said maintenance shall include, but shall not be limited to, winter freeze protection for the plumbing and associated fixtures and lawn maintenance. 4. Lessees shall allow City employees and employees of contractors with the City to have access through the lawn area as desired by said employees. 5. Lessor shall not be liable for the loss of or damage to any of Lessees' personal property on the demised premises. 6. Lessees shall hold Lessor harmless and shall indemnify Lessor for any claim, demand or judgment arising from Lessees' occupancy of the demised premises. .
