RESOLUTION NO. 102-86
"A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO INSTITUTE EMINENT DOMAIN PROCEEDINGS
TO CONDEMN A UTILITY EASEMENT FOR THE CONSTRUCTION
OF A SEWER LINE ASSOCIATED WITH THE WASTEWATER
TREATMENT PLANT IMPROVEMENT PROJECT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETIEVILLE,
ARKANSAS:
That the City Attott,ey is hereby authorized and directed to institute
eminent domain proceedings to condemn the utility easements described
in Exhibit 1 attached hereto and made a part hereof for the purpose
of constructing a sewer line associated with the Wastewater Treatment
Plant Improvement project.

PROPERTY DESCRIPTION:
A part of the Southeast Quarter (SE 1/4) of Section One
(1) Township Sixteen (16) North, Range Thirty (30) West
of the Fifth Principal Meridan, more particularly described
as follows: Commencing at the Southwest (SW) corner of
said Quarter Section and running thence North 1504.5 feet,
thence North 89 degrees 38 minutes East 1320 feet, thence
South 1513 feet, thence West 1320 feet to the point of beginning,
containing 45.85 acres, more or less.
EXISTING PERMANENT EASEMENT DESCRIPTION:
A permanent easement of 40 feet in width, being 10 feet
to the south and 30 feet to the North of a centerline.
The centerline being the centerline of a 24 inch sewer line
and more particularly described as follows, to -wit: Beginning
at a point in the East line of the Northwest Quarter of
the Southeast Quarter of Section 1,. said point being 144.4
feet North of the Southeast corner thereof, and running
thence North 88' 39° West, 1320 feet to a point in the West
line of said property, said point being 114.4 feet North
of the Southwest corner thereof.
EASEMENT DESCRIPTION:
Said easement to be a new permanent easement parallel and
contiguous with the above described permanent easement and
more particularly described as follows, to wit: Beginning
at the Northeast corner of the above described property,
running thence South 40 feet to a point on the North line
of the existing easement, thence North 88' 39° West fifty-five
(55) feet, thence North approximately 40 feet to a point
on the North boundary line of the above described property,
thence North 89' 38° East fifty-five (55) feet to the point
of beginning, containing 0.025 acres, more or less.
