A RESOLUTION EXPRESSING THE WILLINGNESS OF THE
CITY OF FAYEtTEVILLE TO PARTICIPATE IN THE CITY
BRIDGE WAD POSTING PROGRAM.
WHEREAS, the City of Fayetteville understands Federal -Aid Bridge
Replacement and Rehabilitation funds are available for posting structures
that are restricted by weight; and
WHEREAS, it is understood that such bridge posting is mandated
by Federal regulations to insure public safety.
NOW, THEREFORE, BE TT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYETTEVILsE, ARKANSAS:
Section 1. That the City of Fayetteville will participate
in accordance with its designated responsibility in this project.
Section 2. That the Mayor is hereby authorized and directed
to execute all appropriate agreements and contracts necessary to properly
erect the signs at bridges eligible for participation under this program.
Section 3. That the City of Fayetteville pledges its full
support and hereby authorizes the Arkansas State Highway and Transportation
Department to initiate action to implement this program.

AGREEMENT OF UNDERSTANDING
BETWEEN

THE ARKANSAS STATE HIGHWAY AND
TRANSPORTATION DEPARTMENT
In Cooperation with the
U.S. Department of Transportation
Federal Highway Administration
RELATIVE TO
INSTALLATION OF WARNING SIGNS AT BRIDGES WITH RESTRICTIVE WEIGHT LIMITS
WHEREAS, the 1978 Surface Transportation Assistance Act provides Federal -Aid
funds for the erection of warning signs at bridges that are limited by weight,
and
WHEREAS, there are now bridges under the city's jurisdiction that are not in
compliance with the National Bridge Standards,
IT IS HEREBY AGREED that the City of Fqtette.+41(p , hereafter referred to as
the City, and the Arkansas State Highway and Transportation Department hereafter
referred to as the Department, in cooperation with the Federal Highway
Administration, will participate in a cooperativeprogram for the installation

and
FURTHER, accept the responsibilities and assigned dutied as described hereafter.
THE CITY WILL:
1. Be responsible for the purchase of signs that comply with the Manual on
Uniform Traffic Control Devices, Weight Limits Signs (R12-1 to 5). No pay-
ment to the city will be made for signs that fail to meet these requirements.
2. Be responsible for properly installing the signs at the designated locations.
3. Be responsible for installing the signs within six months of the notice to
proceed.
4 Be responsible for maintaining the signs at the city's expense in accordance
with applicable Federal and Arkansas State Highway and Transportation
Department regulations.
Hereby attest that the employement policies and practices with regard to its
employees, any part of whose compensation is reimbursed from Federal funds
will be without regard to race, color, creed, or national origin.

THE ARKANSAS STATE HIGHWAY AND TRANSPORTATION DEPARTMENT WILL:
1. Be responsible for administering Federal -Aid Bridge Replacement and
Rehabilitation Program funds and for supervision of improvement projects
funded through the Federal -Aid Bridge Replacement and Rehabilitation Program.
2. Be responsible for furnishing the locations of the bridges requiring posting
and specifications for the signs.
3. Be responsible for inspecting the signs before final payment to the city.
4. Be responsible for reimbursement to the city of the established unit price.
IT IS FURTHER AGREED that, should the City fail to fulfill its responsibilities
and assigned duties as related in the Agreement, such failure will disqualify
the City from Future participation in any Federal -Aid highway programs.
IN WITNESS WHEREOF, the parties thereto have executed this Agreement this 22nd

On July 1 the Federal Highway Administration notified us that many bridges on
city streets are not in compliance with National Bridge Standards. These
bridges must be strengthened, posted or closed in order to maintain public
safety and to assure continued Federal Aid funding to Arkansas.
The Arkansas State Highway and Transportation Department has established a
program whereby all city bridges with restrictive weight limits will be posted
with appropriate warning signs. Our latest inventory records indicate that
Fayetteville has ten bridge locations requiring such signs.
Your city is responsible for purchasing and erecting the necessary signs and
Federal Aid funds will be used to reimburse you at a fixed rate of $165.60 per
bridge.
Please adopt and return the enclosed resolution along with the signed agreement
of understanding in the self addressed envelope no later than October 1, 1985.
Upon receipt of the resolution, you will be provided a description of the loca-
tion And type- signs to be used, installation instructions, and a notice to `
proceed. It will be the city's responsibility to purchase signs that will meet
the requirements of the program and erect them at the designated locations.
Upon being notified in writing by the city that the signs are in place, our per-
sonnel will inspect the signs and you will then be reimbursed $165.60 in accor-
dance with the Federally established unit price.
Because of the threatened loss of Federal Aid funds, your expeditious handling
of this matter is absolutely critical. If you have any questions or wish to
discuss this matter further, please contact our Programming and Scheduling
Section at 569-2481 immediately.

Enclosed is a Resolution passed by the Fayetteville City Board of Directors
on August 20, 1985; in relation to the AHTD's bridge load posting program.
Also enclosed are two'copies of the Agreement of Understanding between the
City of Fayetteville, Arkansas and the Arkansas State Highway and
Transportation Department relative to the installation of warning signs
at bridges with restrictive weight limits. The Mayor has signed both
copies of the agreement and, after the Director of Highways and
Transportation has executed the Agreement, would you please return
one copy to this office for our records. Thank you.
