A RESOLUTION AUTHORIZING THE MAYOR AND CITY Cr,FRK.
TO EXECUTE A CONTRACT WITH DR. DAVID G. .PARKER
FOR THE PREPARATION OF A BACKGROUND WATER QUALITY
STUDY OF MUD CREEK AND CLEAR CREEK.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYFTTF{1ILE,
ARKANSAS:
That the Mayor and City Clerk are hereby authorized and directed
to execute a contract with Dr. David G Parker for the preparation
of a background water quality study of Mud Creek and Clear Creek.
A copy of the contract authorized for execution hereby is attached
hereto marked Exhibit "A" and made a part hereof.

AGREEMENT
This paameaff executed this it day of Oc-r
1985, by and between David G. Parker, hereinafter called the "Engineer",
and the City of Fayetteville, Arkansas, hereinafter called the "City".
WHEREAS, the City has requested the Engineer to submit a proposal
for a background water quality study of the Mud Creek drainage basin;
and
WHEREAS, the proposal submitted by the Engineer has been found
acceptable by the City.
NOW, THEREFORE, the City and the Engineer hereby mutually agree
as follows:
1. The Engineer shall conduct a background water quality study
of the Mud Creek drainage basin in accordance with the proposal attached

hereto marked Exhibit "A" and made a part hereof.
2. For services performed by the Engineer under this agreement,
the City shall pay the Engineer a lump sum fee of Thirty-four Thousand
Two Hundred Dollars ($34,200.00). Said fee shall be paid in installments
as services are rendered as invoiced by the Engineer. The City shall
pay each invoice within fifteen (15) days from receipt thereof.
3. The City or the Engineer may terminate this agreement at
any time by giving written notice of termination to the other party
by registered mail sent to said party's mailing address. In the event
of termination, the City shall pay the Engineer for actual services
performed to the date of termination. Said payment shall be a percentage
of the total lump sum fee equivalent to the percentage of work to
be performed under this agreement completed on the termination date.
IN WITNESS WHEREOF, the parties have executed this agreement
on the date first above written.
