RESOLUTION ND. 64-85
A RESOLUTION URGING THE ARKANSAS LEGISLATURE TO
ENACT SENATE BILL 19 TO EXEMPT SELF -FUNDING GROUPS
OF PARTICIPATING MUNICIPALITIES OR CDUNTIES FROM
,THE WORKERS' COMPENSATION COMPENSATION WMNIISSION
REGULATIONS.
WHEREAS, the Arkansas Workers' Compensation Commission has rejected
an application by the Arkansas Municipal .League to act as a workers'
compensation self -insurer for many municipalities in the state; and
WHEREAS, said application was rejected by the Workers' Compensation
Commission because the Arkansas Municipal League refused to enter
into an indemnity agreement that would make the group and each member
jointly liable for claims against any member in the group; and
WHEREAS, the Arkansas Municipal League is of the opinion that
such an indemnity agreement would violate Art. 10 of the Arkansas
Constitution; and
WHEREAS, Senate Bill 19 would exempt any self -funding group of
participating municipalities or counties from the Workers' Compensation
Conrtmission'regulations; and
WHEREAS, the Fayetteville Board of Directors believes that the
enactment of Senate Bill 19 is essential for municipalities in Arkansas
to provide workers'.conpensation self-insurance coverage to municipal
employees.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD
CITY OF FAYAT EV11IR, ARKANSAS:
