A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
A1•IORNEY TO INSTITUTE EMINENT DOMAIN PROCEEDINGS
FOR THE PURPOSE OF CONDEMNING A PERMANENT EASEMENT
ACROSS PROPERTY OWNED BY MAE NETTLESHIP TO CONSTRUCT
AND MAINTAIN AN EXTENSION OF DRAKE STREET.
BE IT RESOLVED BY THE BOARD OF DIRECIORS OF TIIE CITY OF FAYETT'EVILLE,
ARKANSAS:
That the City Attorney is hereby authorized and directed to institute
eminent domain proceedings to condemn a permanent easement across
property owned by Mae Nettleship to construct and maintain an extension
of Drake Street. The legal .description of the permanent easement
and temporary, construction easement authorized for condemnation hereby
is attached hereto marked Exhibit "A" and made a part hereof.

PERMANENT EASEMENT
KNOW ALL NEN BY THESE PRESENTS:
That the undersigned Grantor for the consideration of One Dollar
($1.00) and other good and valuable consideration me in hand paid
by the City of Fayetteville, Arkansas, a municipal corporation, the
Grantee, the receipt of which is hereby acknowledged, does hereby
grant, bargain, sell and convey to the City of Fayetteville, Arkansas,
a municipal corporation, the following described permanent easement
located in Washington County, Arkansas, for the purpose of constructing
and maintaining a public street, to -wit:
A 30 foot wide easement of equal and uniform width located in
the NW 1/4 of the SE 1/4 and the NE 1/4 of the SE 1/4 of Section
34; the NW 1/4 of the SW 1/4 of Section 35, All in T -17-N, R -30-W,
being more particularly described as beginning at the NW Corner
of the NW 1/4 of the SW 1/4 of said Section 35, thence S 89°
22' 26" E - 383.71' to the SW Corner of Bishop Addition - Unit
2; thence along the South line of Bishop Addition - Unit 2 S
89° 38' 00" E - 268.66' to the NW Corner of Villa North Subdivision;
thence along the West line of Villa North Subdivision S 4° 37'
41" W (Platted - S 4° 32' W) - 30.08'; thence parallel with the
.South line of Bishop Addition - Unit 2 N 89° 38' 00" W - 266.23';
thence parallel with the North line of the NW 1/4 of the SW 1/4
of said Section 35 and the North line of the SE 1/4 of said Section
34 N 89° 22' 26"W- 1829.13', more or less, to the East Right -of -Way
line of the Burlington Northern Railroad (formerly the St. Louis -San
Francisco Railroad); thence Northerly along said East Right -of -Way
to the North line of the SE 1/4 of said Section 34; thence S
89° 22' 26" E - 1448.58' to the point of beginning, containing
1.45 acres, more or less.
Also, a 50 foot wide temporary construction easement the Northern
boundary of which coincides with the Southern boundary of the
above described permanent easement.
TO HAVE AND TO HOLD said premises to said Grantee, the City of
Fayetteville, Arkansas, for the uses and purposes hereinbefore described.
