A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE A CONTRACT WITH JOHNNY D. TITTLE, d.b.a./
HARMONY BUILDING MAINTENANCE CONTRACTORS FOR MAIN-
TENANCE OF THE RENOVATED CITY ADMINISTRATION BUILDING.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute a contract with Johnny D. Tittle, d.b.a./
Harmony Building Maintenance Contractors for maintenance
of the renovated City Administration Building. A copy
of the contract authorized for execution hereby is attached
hereto, marked Exhibit ."A and made a part hereof.

In consideration of the mutual covenants contained
herein, the parties agree as follows:
1. The Contractor shall perform maintenance services

attached hereto and made a part hereof.
The Contractor shall provide all equipment, tools,
labor, supplies, and materials required for the maintenance
of the above-described building.

of one year commencing on the 1st day of January

6. The Contract documents constitute the entire
agreement'. between the City and the Contractor and may be
modified only by a.duly executed written instrument signed
by the City and the Contractor.
7. The Contractor shall not assign his duties under
the terms' of this agreement.
8. The Contractor agrees to hold the City harmless,
and indemnify the City, against any and all claims for

property ,damage, personal injury or death, arising from
Contractor's performance of this Contract.

This CONTRACT executed this c342, day of d
19 (r between the City of Fayetteville, Arkansas, hereinafter called
the "City", and Johnny D. Tittle of Harmony Building Maintenance Contrac-
tors, hereinafter called the "Contractor".
IN 03NSIDERATION OF THE MUTUAL ODVENANIS ODNTAIINED HEREIN, the
parties agree as follows:
1. The Contractor shall perform maintenance services for the
City Administration Building at 113 W Mountain Street as specified
in the invitation to bid for Bid No. 564 attached hereto and made
a part hereof.
2. The Contractor shall provide all equipment, tools, labor,
supplies, and materials required for the maintenance of the above-described
building.
3. The term of this Contract shall be for a period of one year
commencing on the 1st day of January , 19 86 and ending on
the 31st'' day of December , 19 86 ; provided, either party may
terminate this Contract by giving the other party 30 days written
notice of: termination. The Contractor hereby grants the City the
option to extend the term of this Contract for up to four (4) additional
one-year periods.
4. The City shall pay the Contractor the sum of One Thousand
Four Hundred Eighty-seven Dollars and Fifty Cents ($1,487.50) per
month. Said consideration shall be payable to Contractor on the last
day of each month during the term of this Contract. The consideration
payable to. the Contractor during any option periodshall be the amount
resulting by adjusting the consideration during the previous year
to reflect the percentage change (either up or down) occurring in
the Consumer Price Index, U.S. Bureau of Labor Statistics, Department
of Labor, Dallas Office, through comparing the Index of November 30
in the current period with the Index of November 30 in the previous
period.
5. The Contract documents which comprise the contract between
the City and the Contractor consists of this Contract and the following
documents attached hereto and made a part hereof:

(b) Proposal dated March 26, 1984 executed by John McLarty
and amended by letter dated 1/8/85 by Johnny D. Tittle.
The Contract documents constitute the entire agreement between
the City and the Contractor and may be modified only by a duly executed
written instrument signed by the City and the Contractor.
7. The Contractor shall not assign his duties under the terms
of this agreement.
8. The Contractor agrees to hold the City harmless, and indemnify
the City, against any and all claims for property damage, personal
injury or death, arising from Contractor's performance of this Contract.

Dear Mr. Mackey:
In reviewing the original and present agreements with the City
of Fayetteville for janitorial services, I see it necessary to submit
a price proposal for calendar year 1986. It is my understanding the
City's intent is to create along term working relationship which is
also very agreeable•to my company. For this end we negotiated a 15%
cost reduction from the original proposal in 1984 which set the 1985
monthly price at $1,487.50.
The present monthly cost has proven adequate to sustain the level
of maintenance required by the City, thus, the 1986 proposal price is
the same as present, $1,487.50 per month.
The 1986 terms would remain the same as present which the
addition/of two options as follows:
1. This agreement may be terminated by either party by giving
thirty (30) days written notice by certified mail. The
thirty (30) days to run from the date the written notice
is mailed.
✓2. The City of Fayetteville is offered a five (5) year option
on the present agreement with price adjustments being tied
to the rise or fall of the Consumer Price Index. That
review would be made in November of each year and lock the
price for the next calendar year.

each work day, that is --Monday through Friday,
and perform the specified services at night.
Adjustments in the work schedule will have to be
made from time to time on those occassions when
the City Board of Directors or other groups are
meeting at night so as to avoid the disruption
of any of these meetings, such as vacuum cleaners
running when a meeting is in progress, or if a
meeting is not in progress on that specific floor,
the bidder may work on another floor. In any
event, no worker under this contract shall be
performing any maintenance services••on the floor
on which a meeting is being conducted at the
same time. The contractor shall supply all tools,
equipment, labor, and supplies as needed to per-
form all work under this maintenance agreement.
ON A DAILY BASIS:
Dust all desks and counter tops, clean ash -trays,
empty trash cans, clean door glass and drink-
ing fountains, and dust mop or vacuum all
floors except those listed below
ON A WEEKLY BASIS:
Dust railings on main concourse stairs, fire
stairs, and around "holes" on Second and
Third Floors; dust high ledges and obscure
areas (rotationally, not less frequently than

QUARTERLY:
Clean all light globes, inside and out. The
winning bidder under this invitation shall
submit to the City within five days after
notification of bid award to his or her firm
that they are required to post a performance
bond in the amount of the sum of three months
of payments to the City under this contract.

insurance companies in the city can write these
performance bonds. Also, the winning bidder shall
submit to the City liability insurance coverage and
a liability bond in the sum of $25,000 for dis-
truction of documents. Also, the winning bidder
shall submit a certificate evidencing general public
liability insurance coverage $ 50,000 -200,000 - -
100,000. This insurance is for the
protection of the general public in the case anyone
might become injured or sustain damage due to the
acts or neglect of the winning bidder in carrying
out the work called for under this bid.'
EXTENSION
Again, the site of the proposed work is 113 West
Mountain Street, the City Administration Building.
All prospective bidders prior to submission of a
proposal to the Purchasing officer should walk
through the entire building, with David McWethy floc)" by floor and
become throuroughly familiar with all conditions
to be encountered under this bid. The sub-
mission of a bid will in and of itself indicates to
the City that the person has walked through this
building, floor by floor, and has inspected all
areas to be covered under this bid.
It is the intention of the City that if the success-
ful bidder proves, over a period of a few months,
to provide the kind of services the City is looking

in a neat and Orderly fashion and is not unduly late

As an informational item for all bidders: all
bidders are hereby notified that the City will have
on its own staff persons to perform janitorial tasks
associated with keeping the following areas clean
and neat, therefore prospective bidders should not
include the following areas as part of their bid as
part of the specifications above. Following are
the areas and locations which the City will perform
by using its' own City staff:
1. Mechanical rooms, 016, 106, 229, and 331.
(Includes dusting as necessary).
2. Restrooms 014, 015, 108, 109, 226, 227, 228 & 325
and 330. This service the City will perform
will include the filling soap dispensers and
keeping toilet paper and paper towel dispensers
filled as well as normal cleaning.
