Mastic Corporation warrants to you, the original purchaser of the T-Iok Vinyl -Products) at the address registered on this warranty, T-Iok Vinyl Siding, Soffit and Accessories to be free from manufacturing detects, and will not need painting because there is no paint to chip, peel, blister or flake. This warranty remains in effect for as long as the original purchaser is living and is the owner of the property to which the T-Iok Vinyl Product(s) was (were) applied. Mastic Corporation further warrants these T-Iok Vinyl Products will resist denting because of the high impact resistance of Duranyle and the special T-Iok panel design. Also, because Vinyl is a non-conductor of electricity T-Iok Vinyl Products do not require grounding like metal siding. T-Iok Vinyl Products will not rust like metal siding. All product failure covered by this paragraph will be remedied by Mastic Corporation by repair or replacement in accordance with the applicable terms and conditions of this warranty. Except for the hail damage warranty, described below, this warranty covers only manufacturing defects in Siding, Soffit and Accessories made of Solid Vinyl manufactured by Mastic Corporation. All other causes for material failure including, but not limited to failures or damages resulting from faulty or improper installation, accidental or intentional damage, fire, the owner's failure to provide reasonable and necessary maintenance of the product, flood, lightning, windstorm, earthquake, or other acts of God; settlement of the building, failure of the structure (including foundation and walls), neglect, improper care, surface discoloration due to air pollution, exposure to harmful chemicals, normal and expected weathering of surface, use of accessories that do not properly receive or secure T-bk panels, or other causes beyond the control of the manufacturer are excluded from this warranty. This warranty shall be valid only after the registration certificate if filled in by the Mastic Dealer, signed by the original purchaser of the T-Iok Vinyl Product(s), and mailed to the Mastic Corporation within thirty (30) days after completion of installation. This limited warranty is transferable by the original property owner to subsequent owners of the property, provided Mastic Corporation receives written notice of Transfer of the property within thirty (30) days after the date of transfer of ownership. Failure to so notify Mastic Corporation of the transfer shall relieve Mastic Corporation of any further obligation hereunder. In the event of transfer of the warranty and notice to Mastic Corporation as provided herein, the warranty period shall be for fifty (50) years from the original date of installation and shall be prorated as indicated on the reverse side hereof. If you feel that the T-lok Vinyl Siding and/or T-Iok Vinyl Soffit installed on your home is not free from manufacturing defects, write to the Customer Service Department of Mastic Corporation, 131 South Taylor Street, P.O. Box 65, South Bend, Indiana 466240065, describing the claimed defect. Mastic Corporation will reply within two (2) weeks of receipt of your letter advising of the necessary physical evidence it requires to support your claim. If Mastic determines that the material is defective in accordance with the terms of this warranty, Mastic Corporation will repair or replace (at its option) the defective part or portion, including materials and labor, at no cost to the original purchaser or subsequent owner if the claim is made and approved within the first five (5) years from the date of installation. For claims relating to manufacturing defects made and approved after the first five (5) years from date of installation, Mastic Corporation will assume the cost of material and labor for any warranted work upon payment by the original purchaser or subsequent owner of a Fifty Dollar service payment for each incident under this warranty only to the extent indicated on the schedule on the reverse side hereof, which is incorporated by reference herein. Mastic reserves the right to refund the original purchase price in lieu of repair or replacement. Mastic Corporation also warrants T-lok Vinyl Siding, Soffit and Accessories made of Solid Vinyl,manufactured by the Mastic Corporation, against damage as a result of hail. In consideration of the mutual covenants contained herein, the parties agree as follows: 1. The Contractor shall furnish and install vinyl siding on the old white Hangar Building located at the Fayetteville Municipal Airport (Drake Field) in accordance with contractor's bid under Bid No. 591 dated July 23, 1984. The Contractor shall commence work within 5 calendar days from receipt of a notice to proceed issued by the City Purchasing Office and shall complete construction within 60 calendar days (excluding Saturdays, Sundays, national or state holidays and rainy days as evidenced by Contractor's daily log) after receipt of said notice to proceed. Time is expressly made of the essence of this contract. In the event construction is not completed within the time prescribed hereby, the Contractor shall pay the City the sum of $100.00 per day as liquidated damages, and not as 'a 'penalty, • for each day beyond said 60 day period construction is not ccinpleted. 2. The Contractor shall provide all equipment, tools, labor, and materials required for the construction of the above-described -2 - project as per Bid No. 591 specifications attached hereto and made a part hereof. 3. The City shall pay the Contractor a total sum of $18,355.00 which price reflects the entire lump sum due upon completion of the above-described work. 4. The Contract documents which comprise the contract between the City and the Contractor consists of this Contract and the following documents which are incorporated herein and made a part hereof by reference thereto: 1. The type of siding shall be eight inch vinyl. 2. The color of the siding shall be white. The color of the trim for the doors and windows shall also be white. 3. The materials shall be U.S. Steel Vinyl or Mastic Vinyl siding 4. The total number of estimated squares (for bidders information) is approximately 45. However this bid is not based upon the =number of-squares'required`to`performeaicomplete-,job-.--This .::„,i;' bid is a lump sum turn -key job at the awarded bid price. The City will not pay any additional monies for any other items beyond what is specified in this bid invitation.. Also included in this bid is replacement of fascia boards were needed and replace framing and siding around the air conditioners. There are approximately 381 linear feet of soffit and fascia with a 12 inch overhang. The total bid submitted shall include the following: 5. This bid is for furnishing all material, labor, equipment, and all other things necessary to tear out and replace all boards on the north and south ends of the Old White Hangar building and replace with the siding material specified above. The new material on the gable ends shall be 3/4" plywood CD grade. All siding is to be nailed every 16 inches. It is to be loose nailed so that every panel will move freely on the wall and with 1/4 inch butt cut at joints. The bidders are to install the siding with a breather foil face in and covered with 3/4" Insulbead foam insulation. The job's specifics are as follows for the north and south ends of the main hangar building. Remove"a11'wood•siding in -thr gable -arched -ends and -replace..__ with 3/4" plywood CD grade and cover with the 8" vinyl siding as per specifications above. The metal trim around the top of each arch is to be replaced only if damaged. On the lower areas of the north and south ends all areas east and west of the sliding doors, replace all wood siding not solid enough to nail to and side with vinyl as per specifications above. Cover trim on access door with coil stock. Cover soffit and fascia and trim boards above sliding doors. Cap 2 X next to the sliding doors, this includes siding for wrap around areas on the east and west ends of the lower areas. • Page 2 'Siding On The Old White Hangar 6. Addition on east side of main hangar building. Remove aluminum soffit and fascia and replace with Mastic or U.S. Steel vinyl as per specifications above. The soffit and break fascia with matching coil stock, cover ceiling of porch, wrap side beams, and cover fascia. Remove all Mastic 8" vinyl siding and rehang to specifications above. Also, replace damaged siding with new Mastic siding to replace all damaged panels observed Replace any rotten wood around the windows, doors, and air conditioners and cover with coil stock if not covered by siding. 7. Addition on west side of main hangar building. Remove exsisting gutter, replace any wood on wall area, overhang, doors, windows, and air conditioner trims not solid enough to nail to. When tax is added to $17,625.00 the total would be This is $5,355 over budget. The main reason is that present boards on't e building will not hold a nail for installation of the new siding. Therefore, more new 3/4" CD plywood must be installed after removal of the present siding. The new material for siding would be new 3/4" CD plywood where needed, a breather .foil and 3/4'' Insulbead insulation and vinyl siding. The total amount of the bid award was $17,625.00 plus the 4% Arkansas sales tax and the $25.00 County tax which caps out at $25.00. The total award being therefore, $18,355.00. The first thing which is necessary and which needs to be done as soon as possible, is for the City Attorney to perfect a short contract in- corporating all the provisions of the specifications and your bid and then when this is done I will call you and advise that you need to come in and execute the agreement and take a copy of the agreement to your insurance agent for the purpose of obtaining a 100% performance and payment bond in the total of $18,355.00. After the performance bond is posted with the City you will be given a written notice to proceed. We would hope that we can expedite this job as soon as possible and have it completed within a very short period of time. Also, we would of course expect that clean up around all work areas on the job will occur on a daily basis and all the debris and waste material generated by this work will be removed from the Airport premises and disposed of.
