RESOLUTION NO. 86-84
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
A PERMIT AGREEMENT WITH THE ARKANSAS DEPARTMENT OF HIGHWAYS AND
TRANSPORTATION FOR THE INSTALLATION OF A TRAFFIC SIGNAL AT THE
INTERSECTION OF NORTH COLLEGE AVENUE AND MEADOW STREET.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
That the Mayor and City Clerk are hereby authorized and directed
to execute a permit agreement with the Arkansas Department of Highways
and Transportation for the installation of a traffic signal at the
intersection of North College Avenue and Meadow Street. A copy of
the agreement authorized for execution hereby is attached hereto marked
Exhibit "A" and made a part hereof.

IV. Agreement:
WHEREAS, authority for the control of the locations and types of all traffic
control devices on State Highways has been delegated to the State Highway Commis-
sion by Section 109(d), Title 23, U.S. Code, and Arkansas Statutes 75-501, 75-502,
and 75-503; and
WHEREAS, the State Highway Commission has officially adopted a Manual and
Specifications for a uniform system of traffic control devices, and by Minute Order
3423 of September 30, 1959, has implemented these statutes relative to the installa-
tion of traffic control devices by local governments;
NOW, THEREFORE, in accordance with these authorizations, the following agreement
is made between the.City (applicant) and the Highway Department:
1. The City agrees to install, operate, and maintain the signals at no cost to
the Department.
2. No changes will be made in the controller dial settings, cycle length, and
operation of the signals as noted in this Permit without approval of the Highway
Department. However, periodic review of the operation will be made by the
Department.
3. There will be a minimum of two signal faces per roadway approach or as noted
on the attached sketch.
4. All materials used and installation will be in conformance with the Institute
of Traffic Engineers Specifications, the Manual on Uniform Traffic Control
Devices, and any specifications supplied by the Highway Department.
5. The City will save the Highway Department harmless from any and all damage
claims that may arise during the period the control devices are being installed
or in effect.
6. If the installation has not been completed or is not underway by

In accord with your request of July 9, 1984, enclosed is a Traffic Control
Device Permit concerning the installation of.a traffic signal at the in-
tersection. of Highway 71 Business (College Avenue) and Meadow Street
in Fayetteville. Please note that approval for the signal installation
is conditional upon the City agreeing to remove the signal at the Highway
71B -Center Street intersection.
Please return one signed copy of the permit for our files. You will
also need to contact Mr. Allan Holmes, District Engineer in Fort Smith,
for the necessary work permit prior to construction.
