A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE A MODIFICATION OF THE CITY'S PURCHASE
OPTION WITH C. DALE FREDERICK AND MARY E. FREDERICK
FOR 5.63 ACRES ON ROBINSON MOUNTAIN.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute a modification of the City's purchase
option with C. Dale Frederick and Mary E. Frederick for 5.63
acres on Robinson Mountain. A copy of the modification
authorized for execution hereby is attached hereto, marked
Exhibit "A" and made a part hereof.

HMODIFIeATION OF OPTION TO PURCHASE REAL ESTATE'
This Modification of Optiory.to Purchase Real Estate
executed on the day of
1984, by and
between C. Dale Frederick and Mari;E. Frederick, hereinafter
called "Sellers," and the City of Fayetteville, Arkansas,
hereinafter called "Purchaser."
WHEREAS, the parties have entered into an option to
purchase real estate dated December 6, 1983, a copy of which
is attached hereto, marked Exhibit "A", and made a part
hereof; and
WHEREAS, the parties desire to modify said option.
NOW, THEREFORE, Purchaser and Sellers Mutually agree
as follows:
1. The second paragraph in paragraph 1 of the aforesaid
option isherebymodified to read as follows:
This option may be exercised by written notice of
such exercise delivered to Sellers on or before 12:00
p.m., March 26, 1984; provided, upon payment of an
additional $500.00 by Purchaser to Sellers within sixty
(60) days from the expiration date hereof (March 26,
1984), Purchaser may exercise this option by written
notice delivered to Sellers on or before 12:00 p.m. on
July 26, 1984. Said additional $500.00, is paid, shall
be applied to the full purchase price.
IN WITNESS WHEREOF, the parties have executed this
Modification of Option to Purchase Real Estate on the date
first above written.

OPTION TO PURCHASE REAL ESTATE
In consideration of Five Hundred Dollars ($500.00) paid
to C. Dale Frederick and Mary E. Frederick, husband and wife,
hereinafter called "Sellers", receipt of which is hereby
acknowledged, Sellers hereby grant to the City of Fayetteville,
Arkansas, hereinafter referred to as "Purchaser", the exclusive
option to purchase for the price and on the terms and conditions
hereinafter set forth the real property described in Exhibit
"A" attached hereto and made a part hereof.
1. •The full purchase price for the property shall be
Eight Thousand Dollars ($8,000.00), on which the sum of Five
Hundred Dollars ($500.00) hereby received shall apply. The
balance shall be paid at closing if this option is exercised.
If this option is not exercised, the sum paid by Purchaser
shall be retained by Sellers in consideration of the option.
This option may be exercised by written notice of
such exercise delivered to Sellers on or before 12:00 o'clock
p.m. larch 26, 1984\ provided, upon payment of an additional
$500.00 by Purchaser to Sellers within the original period
of this option, Purchaser may exercise this option by written
notice delivered to Sellers on or before 12:00 o'clock p.m.
on July 26, 1984 Said additional $500.00, if paid, shall
be applied to the full purchase price.
3. Sellers shall convey to Purchaser, or to Purchaser's
nominee, good and marketable title to the property herein
described subject only to easements of record. Conveyance
of title and transfer of possession to Purchaser shall be
executed within sixty (60) days after exercise of the option.
During such period title may be examined by Purchaser by any
method selected. All abstracting or title insurance expenses
and all closing costs shall be borne by Purchaser.
4. Ad valorem taxes against the property •for the year
in which the sale is consummated shall be prorated between
the parties as of the date of delivery of title and possession.

EXCLUSIONS FROM COVERAGE
The following matters are.expressly excluded from the coverage of this policy:
I. (a) Governmental police power.
(b) Any law, ordinance or governmental regulation relating to environmental protection.
(c) Any law, ordinance or governmental regulation (including but not limited to building and zoning ordinances) restricting
or regulating or prohibiting the occupancy, use or enjoyment of the land, or regulating the character, dimensions or
location of any improvement now or hereafter erected on the land, or prohibiting a separation in ownership or a change
in the dimensions or area of the land or any parcel of which the land is or was a part.
(d) The effect of any violation of the matters excluded under (a), (b), or (c) above, unless notice of a defect, lien or encumbrance
resulting from a violation has been recorded at Date of Policy in those records in which under state statutes, deeds,
mortgages, judgment liens or lis pendens must be recorded in order to impart constructive notice to purchasers of the
land for value and without knowledge.
2. Rights of eminent domain unless notice of the exercise of such rights appears in the public records at Date of Policy.
3. Defects, liens, encumbrances, adverse claims, or other matters (a) created, suffered, assumed or agreed to by the insured
. claimant; (b) not known to the Company and not shown by the public records but known to the insured claimant either at
Date of Policy or at the date such claimant acquired an estate or interest insured by this policy and not disclosed in writing by
the insured claimant to the Company prior to the date such insured claimant became an insured hereunder; (c) resulting in no
loss or damage to the insured claimant; (d) attaching or created subsequent to Date of Policy; or (e) resulting in loss or damage
which would not have been sustained if the insured claimant had paid value for the estate or interest insured by this policy.
