RESOLUTION NO.
A RESOLUTION DIRECTING THE CITY ATTORNEY TO DISMISS
THE CITYIJS PENDING LAWSUIT IN WASHINGTON COUNTY
CIRCUIT COURT CHALLENGING THE FISCAL YEAR 1984 PRIORITY
SYSTEM AND LIST ESTABLISHED BY THE ARKANSAS COMMISSION
ON POLLUTION CONTROL AND ECOLOGY.
WHEREAS, the City of Fayetteville is designing improve-
ments to its waste water management system; and
WHEREAS, under an Administrative Order from the United
States Environmental Protection Agency, the City must begin
construction of said improvements by January 1, 1985; and
WHEREAS, said improvements are necessary for the enhance-
ment and protection of the White River and Beaver Lake; and
WHEREAS, maximum grant funding of all system components
is essential to affordable implementation of said improve-
ments; and
WHEREAS, at a recent public hearing and spedial meeting
of the Arkansas Commission on Pollution Control and Ecology,
said Commission reaffirmed its intention to provide the City
of Fayetteville With3maximum grant funding from currently
available or future available construction grants fund.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
That the City Attorney is hereby directed to dismiss
without prejudice the City's pending lawsuit in Washington
County Circuit Court challenging the Fiscal Year 1984
Priority System -and List established by the Arkansas Commission
on Pollution Control and Ecology.
All resolutions, or parts thereof, in conflict herewith
are hereby repealed.
