A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE WITH BEULAH.PHILLIPS AN OPTION TO PURCHASE
A 25 ACRE PARCEL LOCATED SOUTH OF THE CITY'S POLLUTION
CONTROL PLANT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute with Beulah Phillips an option to purchase
a 25 acre parcel located south of the City's pollution control
plant. A copy of the option authorized for execution hereby,
is attached hereto, marked Exhibit "A", and made a part
hereof.
PASSED AND APPROVED this 3rd day of January, 1984.

OPTION TO PURCHASE REAL ESTATE
In consideration of One Dollar ($1.00) paid to Beulah
Phillips, hereinafter referred to as "Seller", and other
valuable consideration, Seller hereby grants to the City of
Fayetteville, Arkansas, hereinafter referred to as "Purchaser",
-the exclusive option to purchase for the price and on the
terms andconditions hereinafter set forth the real property
described in Exhibit "A" attached hereto and made a part
hereof.
1. The full purchase price for the property shall be
Fifty Thousand Dollars ($50,000.00). The full purchase
price shall be paid at closing if this option is exercised.
2. This option may be exercised by written notice of
such exercise delivered to Seller on or before 12:00 o'clock
p.m., on the 30th day from the date of this option.
3. Seller shall convey to Purchaser, or to Purchaser's
nominee, good and marketable title to the property herein
described subject only to easements of record. Conveyance
of title and transfer of possession to Purchaser shall be
executed within sixty (60) days after exercise of the option.
During such period title may be examined by Purchaser by any
method selected. All abstracting or title insurance expenses
and all closing costs shall be borne by Purchaser.
4. Ad valorem taxes against the property for the year
in which the sale is consummated shall be prorated between
the parties as of the date of delivery of title and possession.

Part of the Northeast Quarter (NE 1/4) of the Southeast
Quarter (SE 1/4) of Section Seven (7) and part of the
Northwest Quarter (NW 1/4) of the Southwest Quarter (SW
1/4) of Section Eight (8), all in Township Sixteen (16)
North of Range Twenty-nine (29) West, and being more
particularly described as follows, to -wit:
Beginning at the South West corner of the Northwest
Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of
said Section Eight (8), and running East Eighty (80)
rods; thence North Thirty (30) feet; thence West Forty
(40) rods; thence North Sixty-one rods; thence West
Fifty (50) rods, more or less, to the East line of the
Public Road; thence with the East line of said road
in a Southerly direction to its point of intersection
with the South line of said Northeast Quarter (NE 1/4)
of the Southeast Quarter (SE 1/4) of said Section Seven
(7); thence East alongsaid line to the point of beginning,
containing Twenty-five (25) acres, more or less.
Subject, however, to the right of way of the Public
Road along the South side thereof, all being situate in
Washington County, Arkansas.

said Grantee and Grantee's heirs and assigns, the following described
land, situate in

(SEl/4) of Section Seven (7) and part of the Northwest Quarter
(NW3/4) of the Southwest Quarter (SWIA) of Section Eight (8),
all in Township Sixteen (16) North of Range Twenty-nine (29)
West, and being more particularly described as follows,
to -wit: Beginning at the South West corner of the Northwest
Quarter (NW -174) of the Southwest Quarter (SWl/4) of said Section
Eight (8), and running East Eighty (80) rods; thence North
Thirty (30) feet; thence West Forty (40) rods; thence North
Sixty-one (61) rods; thence West Fifty (50) rods, more or
less, to the East line of the Public Road; thence with the
East line of said road in a Southerly direction to its point
of intersection with the South line of said Northeast Quarter
(NE3/4) of the Southeast Quarter (SEW of said Section Seven
(7); thence East along said line to the point of beginning,

TO HAVE AND TO HOLD the said lands and appurtenances thereunto belonging unto the said Grantee and Grantee's
heirs and assigns, forever. And we, the said Grantors, hereby covenant that we are lawfully seized of said land and
premises, that the same Is unincumbered, and that we will forever warrant and defend the title to the said lands against all
legal claims whatever.
And we, the respective Grantors, hereby release and relinquish unto the said Grantee our respective dowerlcurtesy and
homestead In and to said lands.
