"-i 36 - 84 " A RESOLUTION EXPRESSING THE CONCERN OF THE FAYETTEVILLE BOARD OF DIRECTORS OVER DRAINAGE PROBLEMS CREATED BY HILLSIDE AND HILLTOP DEVELOPMENTS. WHEREAS, hillside and hilltop developments increase the runoff rate of storm water; and WHEREAS, the accelerated flow of storm water caused by hillside and hilltop developments often creates flooding problems for residents at the base of the hillside; and WHEREAS, the City's land development regulations provide that a developer shall install storm drainage facilities designed to serve the entire drainage area, provide that all surface water drainage shall be transported to existing storm sewers, drainage facilities, or natural drainage ditches, and provide that the developer shall be required to install off- site improvements where the need for such improvements is created in whole or in part by the proposed development with the developer to bear that portion of the cost of off-site improvements which bears a rational nexus to the needs created by the development. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the Board of Directors hereby requests that the city engineer, street superintendent, planning administrator, and planning commission be especially conscious of potential drainage problems created by future hillside and hilltop developments and require the developer to install drainage control facilities necessary to protect lower elevation residents from potential damage caused by an increase in the rate of flow and volume of storm water.
