RESOLUTION NO. 35 - 84
A RESOLUTION REQUESTING THE -PLANNING COMMISSION TO
CONSIDER WHETHER THE FAYETTEVILLE ZONING ORDINANCE
SHOULD BE AMENDED TO PERMIT THE ENLARGEMENT OF A
STRUCTURE HOUSING A NONCONFORMING USE.
WHEREAS, the Board of Directors has, upon favorable
recommendation of the Planning Commission, approved certain
rezoning applications to permit the enlargement of structures
housing a nonconforming use; and
WHEREAS, the offer of the property owner to execute a
Bill of Assurance prohibiting any change in use has been a
decisive factor in such rezonings; and
WHEREAS, the Board of Directors questions the advisability
of continuing such procedure; and
WHEREAS, the Board of Directors recognizes that in some
instances the expansion of a structure housing a nonconforming
use may have no adverse impact on the neighborhood.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
That the Board of Directors hereby requests the planning
commission to recommend to the Board of Directors whether the
Fayetteville zoning ordinance should be amended to permit the
planning commission to approve the expansion of a structure
housing a nonconforming use upon a determination by the commission
that there would be no adverse impact on the neighborhood and. -upon
compliance with applicable setback requirements unless said
requirements are varied by ,the board of adjustment.
