A RESOLUTION WITHDRAWING TH QUEST OF THE FAYETTE-
VILLE BOARD OF DIRECTORS THAT THE PLANNING COMMISSION
SUBMIT TO THE BOARD OF DIRECTORS AN AMENDMENT TO THE
FAYETTEVILLE PARKS PLAN

WHEREAS, on November 3, 1983, the Fayetteville Board
of. Directors adopted Resolution No. 139-83 requesting the
Fayetteville Planning Commission to submit to the Board of
Directors an amendment to the Fayetteville Parks Plan so
as to comply with the decision of the Arkansas Supreme
Court in City of Fayetteville v. IBI, 'Inc.; and
WHEREAS, such a proposed amendment was prepared by the
City's planning consultant and was reviewed and approved by
the City Attorney, the Chairman of the Parks and Recreation
Advisory Board, the Parks and Recreation Director, and by
the Planning Commission member who served as chairman of
the Commission when the parks plan and parks ordinance were
adopted; and
WHEREAS, the Planning Commission scheduled a public
hearing on said proposed amendment to the parks plan for
January 23, 1984, and gave notice thereof as required by
law but did not adopt said amendment; and
WHEREAS, the Board of Directors has reviewed said proposed
amendment and has determined that said amendment should be
adopted immediately so that the City may make adequate pro-
vision for public parks.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
That Resolution No. 139-83 is hereby repealed.
