HomeMy WebLinkAbout92-83 RESOLUTIONso • K RESOLUTION NO.__ 92-83 _) A RESOLUTION OBJECTING TO THE 1984 FISCAL YEAR STATE PROJECT PRIORITY LIST DEVELOPED BY THE ARKANSAS POLLUTION CONTROL COMMISSION FOR THE FUNDING OF SEWAGE IMPROVEMENT PROJECTS UNDER THE CLEAN WATER ACT, 33 U.S.C. 1251 et seq., AS AMENDED. WHEREAS, the Arkansas Pollution Control Commission has developed a fiscal year 1984 project priority list for the funding of sewage improvement projects under the Clean Water Act, 33 U.S.0 1251 et seq., as amended; and, WHEREAS, 40 CFR §35.2015(c) (1) provides that the State shall develop the project priority list consistent with the criteria established in the priority system approved by the Regional Administrator of the United States Environmental Protection Agency; and WHEREAS, the 1984 fiscal year priority list developed t l by the Arkansas Pollution Control Commission is not consistent *"."with-the'criteria established inythe•approved priority , i , 1 system; and ' WHEREAS, the specific inconsistency between the 1984 J. Y + . ?fiscal year project priority list and the criteria established in the approved priority system is the proposed funding for the Piney and Pleasant Hill Sewer Improvement Districts and a corresponding reduction in the amount of federal funding for the City of Fayetteville in fiscal year 1984; and WHEREAS, 40 CFR §35.2103 provides that before awarding grant assistance for any project, the Regional Administrator shall determine that the award for grant assistance for the • 1 zl project shall not jeopardize the funding of any treatment works of higher priority under the approved priority system. NOW, THEREFORE, be it resolved by the Board of Directors of the City of Fayetteville, Arkansas: Section 1. That the Board of Directors hereby formally objects to the fiscal year 1984 project priority list developed by the Arkansas Pollution Control Commission because said priority list does not comply with the State's approved priority system as required by 40 CFR §35.2015. Section 2. That the Board of Directors hereby requests the Regional Administrator of the United States Environmental Protection Agency to reject funding for the Piney and Pleasant Hill Sewer Improvement Districts as proposed in the fiscal year 1984 project priority list developed by the Arkansas Pollution Control Commission, because an award of grant assistance to said improvement districts would jeapordize the funding of treatment works of higher priority under the State's approved priority system contrary to 40 CFR §35.2103.
