In consideration of the mutual covenants contained herein, the parties agree as follows: 1. The Contractor agrees to furnish all labor, equip- ment, and materials for the installation of fourteen 400 magnusquare high pressure sodium light fixtures on 30 foot bronze steel standards with concrete base in conduit and wired in accordance with the specifications and terms and conditions incorporated herein and made a part hereof on Maple Street from Arkansas Avenue to Garland Avenue. The contractor shallcommence work on or before 217, ,z 1983; and shall complete all work by 1, 1983. Time is expressly made of the essence of,this contract. In contractor shall pay the City the sum of $:�g; - per day as liquidated.damages, and not as a penalty, for each day beyond' larrj / that all work is not completed. 2. The City agrees to pay the Contractor a lump sum of .$35,814.91 for all labor, equipment,.and materials furnished under this contract. Said sum shall be payable following installation of the aforesaid light fixture and acceptance thereof by the City. 3. The documents which comprise the contract between the City and the Contractor consist of this contract and the following documents attached hereto and made a part hereof: (a) Terms and conditions of Bid No. 519 dated May, 1983; (b) Minimum specifications for Bid No. 519 and addendum to said specifications issued April 14, 1983; (c) Exhibit "A" to Bid No. 519 (drawing reflecting location of light fixtures); the event all work is not completed by the • -2- Bid of Fayette Tree and Trench, Inc.; and Letter to City purchasing officer Sturman Mackey dated May 19, 1983, from University of Arkansas, Associate Vice Chancellor for Administration Tom Dorre. 4. The contract documents constitute the entire agreement between the City and the Contractor and may be modified only by a duly executed written instrument signed by the City and the Contractor. 5. The Contractor shall not assign his duties under the terms of this agreement. 6. The Contractor shall at all times maintain in full force and effect the following insurance: (a) Workman's compensation insurance as required by Arkansas law; (b) Public liability insurance with such company and in such amounts as are approved by the City. 7. The Contractor agrees to hold the City harmless, and to indemnify the City against any and all claims for property damage, personal injury or death arising from the Contractor's performance of this contract. It shall be the sole responsibility of the winning bidder to contact all of the following named companies prior to beginning any work so these people may physically locate .and mark on the ground, the location and approximate depth of their respective utilities: 1. Failure, or refusal to execute a contract. -within five -(5) days after bid award shall be cause for liquidation of the bid bond in favor of the rat City and not in the form of a penalty.' 5. The winning bidder must post a 100 percent performance bond within 10 days after execution of the contract to assure that the work called for herein is completed in a workman like manner and in accordance with the plans and specifications. - These bonds may be posted in cash, cashiers check, certified check or on a suretri bond issued by a company licensed to do business in the State of Arkansas. 6. Bids will beacceptedonly from contractors licensed to do business in the State of Arkansas. The contractors license number must be written on the bid bond and on the outside of the bid envelope. Where trenching takes place, a complete and thorough job of clean-up, on a daily basis, must occur. Backfill of trenching performed in soil shall be replaced with new top soil in a sufficient amount to assure'athat when the back fill has settled, the settlement will end up at existing grade. Also, grass seed shall be sown over the back- fill area immediately after new soil has been placed in the trench. Page 2 8. All work called for under this bid invitation shall be performed under the requirements of the Fayetteville Code of Ordinances and applicable statutes and regulations. 9. All work shall be inspected by the City Inspection Department prior to any backfill. 10. Bids received after the date and time set for receiving bids will not be accepted. 11. The City reserves the right to accept or reject any or all bids, waive formalities in the bidding and make a bid award deemed to be in the best interest of the City. -12. •:It shall be the responsibility of the contractor to assure maintenance of traffic each day on the job and coordinate maintenance of traffic and safety standards with the Fayetteville Police Department, University Security, and the Fayetteville Fire -Department. 13. Properly approved barricades and warning lights shall be used on the job 24 hours each day, including weekends toassure the safety of the general public. 14. The removal_ of existing lights and concrete bases at locations L-3, L-14, and L-5 shall be na coordited_direct_l.y with Ir Jae.Talley.;._U.:of A. Physical Plant Director, 575-6160. The removaT1 of all'other University owned lights along the project area will be performed by University personnel. The removal -..of the existing light pole and electrical wires at L-6 shall be performed by SWEPCO personnel. Contact Mr.. Ivan Faulkner, 521-1800, prior to any work at this site. 15. Insurance certificates evidencing insurance coverage in the following kinds and amounts shall be posted with the City Clerk at the same time the 100 percent performance and payment bond is posted: Workmens Compensation ($100,000. minimumilimit). General Public Liability ($500,000/$500,000/$250,000). Comprehensive Automobile Liability ($500,000 each person - $.1.,000,000 each. occurrance-$100,000 property damage each occurrance). Contractors Excess Umbrella Policy, $1,000,000. Indemnification and (All Risk) Builders Risk Insurance. 16. A formal contract will be perfected by the City's Attorney after contract award. This contract will incorporate in its provisions Exhibit "A", Notice to Prospective Bidders, which includes the specifications, and the Terms and Conditions. 17. If rock is encountered duringthe drilling of any of the holes for the mounting bases, this rock shall be broken up for removal by a jack hammer. Page 3 18. CITY QF FAYETTEVILtE, ARKANSAS NOTICE TO PROSPECTIVE BIDDERS BID NO. 519 MINIMUM SPECIFICATIONS GENERAL: Maple Street - Street Lighting Project GENERAL SCOPE OF WORK: Trenching, furnish all materials (except lighting fixtures which are to be furnished by others) including but not limited to conduit, wire and function boxes, concrete fill except where trenching is in dirt. There are fourteen fixtures which are 400 watt Maghusquare high pressure sodium on 30' bronze steel standards with concrete base to be constructed by Contractor. ELECTRICAL. POWER DROPS AND LENGTH OF RUNS: The power drops are to be 120/240 V. There are to be two drops as marked an attached Exhibit "A" as follows: At north side of Maple directly across from Arkansas Avenue intersection at existing pole. This drop will serve four fixtures as shown on Exhibit "A". On Leverett Avenue, east side of street approximately 160 feet north of intersection with Maple. This drop will serve 10 fixtures as shown on Exhibit "A". Conduit at this service drop is already in place and runs to the northwest corner of Leverett and Maple, thence runs across Maple to southwest corner of intersection, approximately 60 feet, thence east to its termination where only one (1) light fixture is served on south side of Maple as shown on Exhibit "A"-, L-5, approximately 200 feet. All of this existing conduit is one inch PVC, Schedule 40. Existing fixture and concrete base at L-5, is to be removed by Contractor and the new fixture and base installed in the exact location. CONDUIT AND WIRE: All conduit shall be at least one inch PVC, Schedule 40 with water proof connections. The four fixtures served by power from the Arkansas Avenue drop shall be wired with a minimum of 3 wire #6 THW copper or #4 URD aluminum, with either wire to provide 120/240 V. The ten fixtures serviced from the Leverett Avenue drop, shall be wired with 3 wire #1 THW copper, 120/240 V or #1/0 URD aluminum. If aluminum wire is used anywhere on the job, there shall be compression connections at each joint and at each termination. TRENCHING: Trenching shall be 4 inches wide and 18 inches deep and be repaired by filling completely with '3,000 PSI Portland cement concrete, finish truck pour and broomed to an even -with -grade finish. Page 2 Trenching shall begin at L-1 at Arkansas Avenue on the (north side of Maple, approximately 20 inches South of the curb and continue west to the north- west corner of Maple and Whitham Avenue. At this point, the existing side- walk from Whitham to the first -alley West (approximately 207 linear feet), will be removed by others and prepared for a new sidewalk and curb and gutter. Thus, trenching along this stretch may take place in the area where the new sidewalk will be poured. At the end of this new sidewalk area, trenching will again resume in the street and terminate at L-4 as shown on Exhibit "A" attached hereto and made a part hereof. One street crossing is to be madeas shown on Exhibit "A" for this run to serve L-3. An existing light fixture is now in place at L-3. This fixture and base shall be removed and a new fixture and base installed at this point by Contractor. The estimated trenching length from L-1 to L-4 and including the street crossing is 531 linear feet, more or less. Trenching shall begin again at the proposed junction box location at the southwest corner of Maple and the short._a;lley. Trenching shall then cut through the curb and gutter to about 20 inches north of the south curb line oh Maple and thence run West approximately1150 linear feet. There are three street crossings along this run to serve the three fixtures as shown on Exhibit "A". These three crossings are approximately 66 linear feet each. The termination point on this run is at L-13 as shown on Exhibit "A" The final fixture shall be installed at the exact location of the present fixture as shown on Exhibit "A" as L-14. The present fixture and base is to be removed by the Contractor and the new fixture and base installed in the exact location - NOTE -the base for the new fixture shallinot.be.located any further north than the north side of the existing mounting base. This is very important because of the possibility of conflict with underground, highvoltage wiring. Trenching for this fixture is to run 4 inches wide and 8 inches deep to the westIside of the s"outh steps of the Phi, -Mu :House. This run is approximately 68 linear feet. At the entrance to the basement area, the conduit shall be at least 3/4 inch EMT with weather-proof connections. This is to lead to a 60 amp disconnect and be wired to the power source in the transformer room as determined by Mr. Ralph Uher.through Mr. Joe Talley, Director of U. of A. Physical Plant at 575-6160. Before any work whatsoever is begun in the area of L-14, the Contractor must call Mr. Joe Talley atthe above phone number so that proper coordination of the work in this area canbe assured. The new fixture at L-6 is to be located exactly where the present pole light is located. Contractor shall include in his bid price the removal of this pole and the subsequent installation of the new light fixture. Page 3 CONCRETE BASE SPECIFICATION: The holes for all 14 steel standard mounting bases shall be five (5) feet deep X 24 inches round. The anchor bolts (furnished. with the fixtures:and steel standards) are 1".X 40" long.. All light fixtures, steel standards and accessory hardware is to be pickedeup at the Swepco Yard off of Township Road. Also, a template may be -borrowed. from SWEPCO for bolt alignment. This plate may be acquired through. Floyd Hornaday and must be returned to SWEPCO after the job is completed. Each hole will require approximately -1 1/4 cubic yards of 3;000 P..S.I. concrete finish truck pour. CITY OF FAYETTEVILLE, ARKANSAS BID NO. 519 MAPLE STREET LIGHTING PROJECT ADDENDUM TO SPECIFICATIONS ISSUED: APRIL 14, 1983 The following items are hereby added to the bid specifications on the above reference project. (1) All trenching in the street shall be saw cut. (2) All footages shown in the specifications and on Exhibit "A" are estimated. These estimates were obtained from field measurements but may not be exactly accurate. It is each bidders responsibility to satisfy themselves as to the exact footage requirements for trenching and amount of conduit and wiring necessary to complete the entire job as specified. The lump sum bid awarded will be the total sum of money for the contract and may not be modified after contract award. (3) The 120V requirement for each fixture shall be guaranteed not to vary plus: or minus 5%. Personnel of the City and their contractors are granted permission to enter upon University of Arkansas Fayetteville campus property to perform installation of street lighting equipment as specified under Bid No. 519. 2. The University of Arkansas at Fayetteville agrees to reimburse the City for the construction of approximately 207 linear feet of new replacement sidewalk to be installed on the north side of Maple Street beginning at the northwest corner of the intersection of Maple and Whitham Streets and running west apprbxiitiately,s207 linear feet to an existing alley. The cost to the University for this sidewalk replacement will be at the City's contracted rate per linear foot of $4.45 for four foot wide sidewalk or $5.56 for five foot wide sidewalk depending on the width of the walk re- quired to be installed. It is agreed that the sidewalk will be constructed by the City's contractor, Gintonio Concrete ConstructionCompany. The University further agrees to provide as required by City personnel and/or City contractors' personnel the assistance of our Department of Public Safety and/or personnel of our Department of Transit and Parking to control parking and/or traffic flow through University owned parking areas along the south side of Maple Street between Garland and University Avenues. During the life ofthis street lighting project contractors' personnel will be solely respon- sible for the maintenance of traffic and safety standards and providing approved barricades and warning lights as required in Paragraphs 12 and 13 of the project terms and conditions.
