A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A CONTRACT WITH NORTHWEST ELECTRIC, INC. FOR
THE INSTALLATION OF A SECONDARY UNDERGROUND ELECTRICAL
DISTRIBUTION SYSTEM FOR BUILDINGS NEAR THE CITY ADMIN-
ISTRATION BUILDING AT.A TOTAL CONTRACT PRICE OF $32,943.00.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute a contract with Northwest Electric, Inc.
for the installation of a secondary underground electrical
distribution system for buildings near the City Administration
Building at a total contract price of $32,943.00.

CONTRACT
This contract executed this.0204 day of
,
1983, between the City of Fayetteville, Arkansas,- hereinafter
called "the City," and Northwest Electric, Inc., hereinafter
called "the Contractor."
In consideration of the mutual covenants contained
herein, the parties agree as follows:
1. The Contractor shall furnish all labor, equipment,
and materials for the installation of a secondary underground
electrical distribution system to specified buildings near
the City Administration Building. The work includes, but is
not limited to, trenching, patching of parking areas and
alleys, installation of wiring and conduit, reconnection of
removed overhead electrical services,installation and
capping of miscellaneous conduits, and repair and patching
to existing buildings where electrical service rework has
taken place. The Contractor shall commence work on or
before (p, , 1983, and shall complete all work
by

AO, 1983. Time is expressly made of the essence
contract. In the event all work is not completed by
the Contractor shall pay the City the
sum of $‘51,2: -C" -per day as liquidated damages, and not as
a penalty, for each day beyond f�,4 at all work
is not completed.
2. The City agrees to pay the Contractor a lump sum
of $32,943.00 for all labor, equipment, and materials furnished
under this contract. Said sum shall be payable upon installa-
tion of the aforesaid secondary underground electrical dis-
tribution system and acceptance thereof by the City.
3. The documents which comprise the contract between
the City and the Contractor consist of this contract and the
following documents attached hereto and made a part hereof:
(a) General conditions as prepared by Hailey-Powers-
Froning Architects, Ltd. dated April 14, 1983
(three sheets);

4. The contract documents constitute the entire
agreement between the City and the Contractor and may be
modified only by a duly executed written instrument signed
by the City and the Contractor.
5. The Contractor shall not assign his duties under
the terms of this agreement.
6. The Contractor shall at 'all times maintain in full
force 'and effect .the following insurance:
(a) Workman's compensation insurance as required by
Arkansas law;
(b) Public liability insurance with such company and
in such amounts as are approved by the City.
7. The Contractor agrees to hold the City harmless,
and to indemnify the City against any and all claims for
property damage, personalinjury or death arising from the
Contractor's performance of'this contract.
IN WITNESS WHEREOF the parties have executed this
contract on the date first above written.

1. Install meter socket (supplied by SWEP.CO) and frame at
location shown on drawing..
2. Install underground services from meter pedestal to the
interior of east wall and all other related gear as required
for a complete job. If service entrance is -not within 5'
o f building panel, this contractor is to intta1•1, complete
with base, a 400A fused, weathertight disconnect adjacent to
the meter pedestal.
Service conduit is not to be exposed on exterior wall.
4. Remove and return to SWEPCO all overhead service gear now
located on east building wall. Patch as directed.
5. See General Note #22.
II. Chamber of Commerce
1,. Install meter socket (supplied by SWEPCO) and frame at
location shown on drawing.
2. Install underground service from meter pedestal to existing
4OOA disconnect on south wall of building. Conduit is to
be exposed at exterior wall
3. Remove meter socket and return to SWEPCO.
4. Remove overhead mast and return to building owner. Patch
as directed.
5. See General Note # 22.
III. City Administration Building
1. No work is required under this contract.
IU. KHOG
1. Install HQ -5U meter socket (furnished by SWEPCO) adjacent to
e xisting meter.
2. Install underground service from SWEPCO transformer area to
n ew meter socket.
3 Remove existing meter socket and return to SWEPCO, return
mast to building owner. Patch as directed:

VII. Fayetteville Police Department
I. -Install 320A 10 meter socket (furnished by SWEPCO) to east
side of existing door.
2. Install underground services from SWEPCO transformer area to
meter socket.
3. Install wiring and conduit from. meter socket to existing
switchgear inside of building.
4. Remove overhead risers and patch as directed. City to
retain risers.
5 See General Note # 22.
Each business•"must`have minimum of seven (7) days written notice
o f switchover. In all cases, switchover time must be held to an
absolute minimum and fully coordinated with building owner or.
managers. The following are to be contacted:

This contractor assumes full responsibility for coordination with
all businesses and SWEPCO. -
23. Patch to match except where new alley construction is to take place.
24.' Pa.tch:all buildings surfaces and roofs as necessary where electrical
e quipment has been removed asdirected by architects.
25. Submit a minimum of 3 copies on all shop drawings dealing with
w iring and connectors, conduit and fittings, disconnects and
o ther miscellaneous gear as required by architect.
26. Contractor shall fully cooperate and coordinate everything necessary
to complete this project with the City, Kan -Ark, affected building
owners and the architects.

THE INTENT OF THIS CONTRACT IS TO REPLACE
ALL OVERHEAD SERVICES TO BUILDING AS SHOWN
ON PLANS WITH NEW UNDERGROUND SERVICE.
CONTRACTOR IS RESPONSIBLE FOR ALL CODE
COMPLIANCES IN SIZING OF NEW SERVICES. USE
THW WIRE AND SCHEDULE 40 PVC CONDUIT EXCEPT
WHERE OTHERWISE NOTED. ALL FITTINGS TO BE
WATERTIGHT.

GENERAL NOTES
1. All conduit, unless otherwise noted, is to be as manufactured under
the trade name "Cantex" or other as approved for use by Southwestern
Bell. Conduit to be PVC, 4" in diameter with all necessary bends,
sweeps and fittings necessary for installation to be approved by
Southwestern Bell.
2. Attached drawing shows schematically the point of beginning and each
terminal at building routing is to be worked out in the field with
architects. Conduits may be runsame trench as secondary power,
provided that a minimum of 1'-0" vertical clearance be maintained
with the empty conduit on top.
3. Warner Cable and Woolworth buildings are not a part of the UTDC Syster
4.. Collection point for a future manhole installation is as shown on
drawing (P.O.B.). Cap conduits and pave over a minimum of 6" below
finish paving. Mark permanently for future use.
5. This contractor to locate at base of pole, as shown on drawing,
2 - 4" conduit (existing) --one is in use and one is vacant. Locate
vacant conduit, coordinate with Southwestern Bell so that Southwesterr
Bell can rod out to SW Bell manhole in Block Street. If conduit
is in good shape, splice to west end and extend to new point of
beginning. Run additional 4" conduit from point of beginning back
to pole- and cap below grade. Furnish with bid price a lump sum
price for complete installation of two (2) 4" conduit from the
point of beginning, but not including connection, to Southwestern
Bell manhole at Block Street. The intent of this paragraph is to
allow connections from future manholeslocated at the point of
beginning to the manhole on Block Street, in case the above mentioned
existing conduit is not usable.
